THIS INDENTURE, made the 18th day of January, Two Thousand Two
BETWEEN
BRUCE E. SAUL, residing at 1200 Youngs Road, Orient, New York 11957,
party of the first part, and
FRANK GiANNELLI and JUDY GIANNELLI, husband and wife, residing at 2449 Pinetree
Place, Yorktown Heights, New York 10598,
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Orient, in the Town of Southold, County of Suffolk, and
State of New York, being more particularly bounded and described as follows:
BEGINNING at a point on the easterly side of Youngs Avenue which point is the
northwesterly corner of land now or formerly of Cassidy and the southwesterly corner of the
premises herein described and from said point of beginning said point also being distant
1345.95 feet northerly as measured along the easterly side of Youngs Avenue from the comer
formed by the intersection of the easterly side of Youngs Avenue with the northeasterly side of
Main Road (NYS 25);
RUNNING THENCE along said easterly side of Youngs Avenue, North 09 degrees 16
minutes West 95.0 feet to land now or formerly of Begora;
THENCE along said land of Begora, North 77 degrees 59 minutes 50 seconds East, 150.0 feet;
THENCE along land now or formerly of Latham, South 09 degrees 16 minutes East 95.0 feet
to the northeasterly side of land of Cassidy;
THENCE along land last mentioned, South 77 degrees 59 minutes 50 seconds West 150.0 feet
to said easterly line of Youngs Avenue and the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated March 6, 1998, and recorded March 20, 1998, in the Office of the Suffolk County
Clerk in Liber 11884, Page 429, and by deed dated January 7, 2002, and recorded January 10,
2002, in the Office of the Suffolk County Clerk in Liber 12162, Page 926.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
