(631) 765-1809 · Fax (631) 765-9064 FINDINGS, DELEBERATIONS AND DETERMINATION MEETING OF JIJNE 14, 2007 ZB File No. 6032 - Cheryl and Erik Hansen Properly Location: 445 Elizabeth Lane, Southold CTM 78-5-3 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicants' 24,677 sq. ft. parcel has 25 feet along a traveled private right-of-way (referred to as Elizabeth Lane) and is improved with an existing single-family dwelling as shown on a survey prepared by John Metzger, Land Surveyor dated 9/17/98 revised 2/22/07. Two yards of the property are BASIS OF APPLICATION: Request for a Variance under Section 280-116B, based on the Building Inspector's November 21, 2006 Notice of Disapproval and applicants' request for a building permit, concerning proposed reconstruction and relocation of an existing sunroom at less than 75 feet from the easterly bulkhead, SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred to the Suffolk County Department of Planning as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and in a letter to the Zoning Board of Appeals dated May 2, 2007, the County confirmed that the application is considered a matter for local determination as there appears to be no significant county-wide or inter- community impact. TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: This application is not subject to the LWRP and is an exempt minor action under the Town Code, and a letter recommending same ~vas submitted on May 30, 2007 to the Zoning Board of Appeals from the LWRP Coordinator. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 31, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to reconstxuct the existing 16' x 16' sun room and add a 5 ft. overhang, resulting in a setback of +/- 36 feet measured from the existing easterly bulkhead and 61 +/- feet from the bulkhead on the landward side of the existing dwelling, as described in a February 22, 2007 survey prepared by John T. Metzger, land surveyor. Page 2 - June 14, 2007 ZB File No. 6032 - Cheryl and Erik Hansen CTM No. 78-5-3 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The setback from the bulkhead to the existing sunroom is 39 feet, and the new sunroom will he +/-36 feet, measured from the closest comer of the proposed overhang. The applicants are requesting a 5' overhang (open, roofed over structure) to the new sunroom for better protection from the weather. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance. The proposed five-foot overhang will be closer at the comer section by 3 feet, toward the bulkhead. There are no other means to give protection from the elements. 3. The variance granted herein is not substantial. Only the addition ora 5 ft. overhang will create a 3 fi. closer setback on a comer adjacent to the bulkhead. 4. The difficulty was created when the owner decided to rebuild the sunroom and to add a five ft. overhang on the comer of the dwelling adjacent to the easterly canal. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of an overhang with a new sunroom, after removing the existing sunroom, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Goehringer, and duly carried, to GRANT the variance as applied for, as shown on the survey prepared by John Metzger, Land Surveyor dated 9/17/98 revised 2/22/07 and construction drawings stamped received by ZBA April 13, 2007. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that nmy violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
