Apostle and Linda P. Apostle Trust dated December 1, 2004, as to an undivided fifty percent (50%) interest, and THOMAS C. STEVENSON and JILL A. STEVENSON, his wife, as to an undivided fifty percent (50%) interest, all residing at 24850 Main~' Road, Orient, New York 11957, PARTY OF THE FIRST PART, AND the COUNTY OF SUFFOLK, a municipal corporation of the State of New York, having its principal offices at 310 Center Drive, Riverhead, New York 11901, PARTY OF THE SECOND PART, WITNESSETH, that pursuant to Chapter 8 of the Suffolk County Code, and in accordance with Article XXXVI of the Suffolk County Charter and Resolution No. 285-1981, as amended, and Resolution No. 877-2005, and Resolution No. 1328-2006 of the Suffolk County Legislature, that the PARTY OF THE FIRST PART, in consideration of SIX HUNDRED EIGHTY-EIGHT THOUSAND SEVEN HUNDRED FIFTY and 00/100 DOLLARS ($688,750.00) and other good and valuable consideration paid by the PARTY OF THE SECOND PART, DOES HEREBY GRANT AND RELEASE unto the PARTY OF THE SECOND PART, the successors and assigns of the PARTY OF THE SECOND PART forever, THE DEVELOPMENT RIGHTS. ~ by which is meant the permanent legal interest and right, as -dfi~fi~'~d~ ~7 ~he I{lew '~ork State General Municipal Law, as amended, and Local Law 16-1981 of the County of Suffolk, as amended, to permit, require or restrict the use of the premises exclusively for agricultural production as that term is defined in Local Law 16-1981 of the County of Suffolk, as amended, and the right to preserve open space as that term is defined in §247 of the New York State General Municipal Law, as amended, and the right to prohibit or restrict the use of the premises for any purpose other than agricultural production, to the property described as follows: ALL that piece or parcel of land, situated in the Town of Southold, County of Suffolk, and State of New York, more particularly bounded and described as follows: (see description annexed hereto and made a part hereof): BEING AND INTENDED to be part of the same premises conveyed to Ronald P. Apostle and Linda P. Apostle, his wife and Thomas C. Stevenson and Jill A. Stevenson, his wife by deed dated June 6, 2002 from Mark Stephen Phillips and Mary Bess Phillips and recorded June 26, 2002 in Liber 12194 at page 075, of which fifty percent (50%) of the same premises was thereafter conveyed to Ronald P. Apostle and Linda P. Apostle as Co-Trustees of the Ronald P. Apostle and Linda P. Apostle Trust dated December 1, 2004 by deed dated January 11, 2005 from Ronald P. Apostle and Linda P. Apostle, his wife and recorded March 17, 2005 in Liber 12377 at page 254. Said premises are further described by Suffolk County Tax Map Number 1000-018.00-06.00-005.000. TO HAVE AND TO HOLD the said DEVELOPMENT RIGHTS in the premises herein granted unto the PARTY OF THE SECOND PART, its successors and assigns, forever; AND the PARTY OF THE FIRST PART covenants that the PARTY OF THE FIRST PART has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. The PARTYOF THE FIRST PART, as a covenant running with the land in perpetuity, further covenants and agree for the PARTY OF THE IqRST PART, and the heirs, legal representatives, successors and assigns of the PARTY OF THE FIRST PART, to use of the premises on and after the date of this instrument solely for the ~urpose of agricultural production.
