THIS INDENTURE, made the ~~'7~ day of May, in the year Two Thousand Two
BETWEEN
DARLINE B. McG1NNESS, residing at 25760 Main Road, Orient, New York 11957
party of the first part, and
ROBERT V. McGINNESS and DARL1NE B. McG1NNESS, husband and wife, both residing at
25760 Main Road, Orient, New York 11957
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being in the Hamlet of Orient, Town of Southold, County of Suffolk, State of
New York, bounded and described as follows:-
BEGINNING at a point on the south side of Main Road at the northeast corner of land of
McCammond formerly of Hoyt, which point is the northwesterly corner of the premises herein
described;
RUNNING THENCE along the southerly line of Main Road, North 63 degrees 41 minutes 40
seconds East, 255.00 feet to the northwesterly corner of land formerly of Louis Young;
THENCE along the westerly line of land formerly of Louis Young, South 36 degrees 30
minutes 50 seconds East, 283.00 feet to a point;
THENCE along land formerly of George L. Edwards, South 53 degrees 29 minutes 10 seconds
West, 247.35 feet to land of Robert Gillispie;
THENCE along lands of Gillispie and McCammond, North 37 degrees 08 minutes 30 seconds
West, 328.22 feet to the point or place of BEGINNING.
SUBJECT TO a right of way over the westerly 15 feet and a right of way over the easterly 10
feet of the premises herein described extending from the Main Road to other lands formerly of
George L. Edwards lying to the south of and adjacent to the premises hereinabove described.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from William H. Price, Jr., as Executor of the Estate of John M. Appelt dated June 5,
1996, and recorded in the Suffolk County Clerk's Office on June 21, i996, in Liber 11779
page 327.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, lhe heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right Io receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
