SAID PREMISES being known as Rocky Point Road, East Marion, New York (Section
021.00, Block 01.00 Lot 009.000).
TOGETHER with all fight, title and interest, if any, of the pawl of the first part in and to any
sm:et and roads abutting the above described premises ~o the center lines thereol~ TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever.
AND the party otthe first part covenants that the party of the Ii~t part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as

ALL that certain plot, piece or parcel of land, situate, lying and being in the Town
of Southold, County of Suffolk and State of New York, known and designated as
Lot Number 4 on a certain map entitled, "Map of Stratmors Estate East Marion,
Town of Southold, Suffolk County, New York, made by Otto W. Van Tuyl & Son,
L. S., dated November 19, 1982," and filed in the Office of the Clerk of the
County of Suffolk on the 20th day of February 1963 as Map #3723, bounded and
described as follows:
BEGINNING at a point at the intersection of the northerly side of Stratmors Road
and the westerly side of Rocky Point Road;
Running thence along the northerly side of Stratmors Road South 82 degrees 54
minutes 40 seconds West, a distance of 180.00 feet to Lot 5 as shown on said
map;
thence along the division line between Lots 4 and 5, North 17 degrees 43
minutes 20 seconds West, 105.00 feet;
thence along the division line between Lots 3 and 4 North 79 degrees 44 minutes
00 seconds East, 195.10 feet to the westerly side of Rocky Point Road;
~Ihence along the westerly side of Rocky Point Road, South 13 degrees 45
minutes 10 seconds East, 39.38 feet;
thence still along the westerly side of Rocky Point Road, South 7 degrees 5
minutas 20 seconds East, 74.89 feet to the northerly side of Stratmors Road at
the point or place of BEGINNING.
AND the party of'the first pan, in compliance with section 13 of the Lien Law, covenants that
the party of the fu~t part will receive the consideration for this conveyance and will hold the
~,ht to receive such consideration as a trust fund to be applied first for the purpose of paying
.the cost of the improvement and will apply the same f~t to the payment ofthe cost of the
unprovement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
