WI'I'NESSETH, that'thc party oflhe first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, docs hereby grant and release unto the party
of the second part. the heirs or sueee.~sors and assigns of the party oftha second part forever, all
of his one-third interest in and to
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
ereeted, situate, lying and being at East Marian, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows:
BEGINNING at a point on the easterly side of Right of Way known as Circle Drive, distant
294.45 feet southerly from the coroer formed by the intersection of the easterly side of Circle
Drive with the southerly side of Aquaview Avenue;
RUNNING THENCE along the easterly side of Circle drive the following two courses and
distances:
(!) South 2 degrees 00 minutes IX) seconds Fast, 55 feet; and
(2) South 16 degrees 08 minutes 00 seconds East, 55 feet to thc northerly end of an
irregular curve connecting the easterly side of Circle Drive with the northwesterly side of a
second Right of Way;
THENCE along said curve, on a tie line of North 67 degrees 35 minutes 00 seconds East,
having a length of 142.76 feet;
THENCE North 8 degrees 58 minutes 20 seconds West, along land now or formerly of E.A.
Brown, 82.58 feet~ and
THENCE South 78 degrees 18 minutes 40 seconds West, 139.14 feet to the easterly side of
Circle Drive and the point or place of BEGINNING.
TOGETHER with an easement or Right of Way over Circle Drive and Aquaview Avenue for
access to and from Rocky Point road.
TOGETHER with a Right of Way running with Ihe land hereby described over a strip of land
lying between the northerly line of Aquaview Avenue and Long Island Sound, more
parlicularly described as follows:
BEGINNING at the southwesterly comer of land of Alexander Lehram; and
RUNNING THENCE westerly along said northerly line of Aquaview Avenue forty-five (45)
feet to land of Stewart;
THENCE along said land of Stewart, Nonh 7 degrees 10 minutes 10 seconds West, two
hundred sixty (260) feet, more or less, to Long Island Sound;
THENCE easterly along said Long Island Sound, fifty-nine (59) feet, more or less;
THENCE along said land of Alexandra Lehram, South 4 degrees 10 minutes 10 seconds East,
two hundred eighly (280) feet, more or less, to the point of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 1/8/66 and recorded 1/13/66 in the Office of the Suffolk County Clerk in Liber
5894, Page 69.
TOGETHER with all right, title and interest, if any, of the party of the first pan in and to any
streets and roads abutling the above described premises to the center lines thereof; TOGETHER
with the appuneoanees and all the estate and rights of the party of the first pan in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first pat1 covenanLs that thc party of thc first pan has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND thc party of thc first pan, in compliance with Section 13 of the Lien Law, covenants that
thc party of the tics! part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a Irost fund to be applied first for the purpose of paying thc
cost of the improvement and will apply the same first to the paymcm of the cost of the
improvement before using any parl ofthe total of the same for any other purpose.
Thc word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
