GEROSA, residing at 39 Rugby Road, Mnnhasset, New York 11030 an undivided 25% share VINCENT M. GEROSA residing at 2 Constitution Ct., Apt 303, Hoboken, NJ 07030 an undivided 25% share and MARIA G. BULLS, residing at 64 Eton Road, Yonkers, New York 10708 an undivided 16.7% share, ERIC I. BULLS residing at 350 7~ Street, Apt 3E, Hoboken, NJ 07030 an undivided 16.7% share and RUDOLF J. BULLS residing at 304 Hudson Street, Apt I, Hoboken NJ 07030 an undivided 16.6% sham party ortho second part, WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration paid by the patty of the second pan, does hereby granl and release unto the party of the second pan, the heirs or successors and assigns orthe party of the second part forever, his one-third interest in and to ALL that certain plot, piece or parcel of land, with the buildings und improvements thereon erected, situate, lying and being at East Marion, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the easterly side of a Right of Way known as Circle Drive, distant 184.45 feet southerly from the corner formed by the h~tersection of the easterly side of Circle Drive with the southerly side of Aquaview Avenue; RUNNING THENCE North 89 degrees 26 minutes 40 seconds East, along land ~ow or formerly of Schaumberg, 127 feet; THENCE South 8 degrees 58 minutes 20 seconds East, along land now or formerly of E.A. Brown, 84 feet; THENCE South 78 degrees 18 minutes 40 seconds West, 139.14 feet to the easterly side of Circle Drive; and THENCE North 2 degrees (30 minutes 00 seconds West, along the easterly side of Circle Drive, i 10 feet to the point or place of BEGINNINO. TOGETHER with an ~asen~ent or Right.of Way over Circle Drive and Aquaview Avenue for access to and from Rocky Poim Road. TOGETHER with a Right of Way over a certain strip of land running from Aquview Road to Long Island Sound, more particularly described as follows: BEGINNING at a slake on the northerly line of Aquaview Road and distant 490 feet easterly from the easterly line of Rocky Point Road measured along said northerly line of Aquaview Road; RUNNING THENCE North 7 degrees 10 minutes 10 seconds West 260 feet, more or less, to Long Island Sound: THENCE easterly along said Long Island Sound 59 feet, more or less; THENCE South 4 degrees 10 minutes 10 seconds East, 280 feet, more or less, to said northerly line of Aqueview Avenue; THENCE along said northerly line of Aquaview Avenue, North 83 degrees 10 minutes 10 seconds West, 45 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated 118166 and recordcxl 1113166 in the Office of the Suffolk County Clerk in Liber 5892, Page 464. TOGETHER with all fight, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and fights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of'the parly of the second part forever. AND the party of the first part covenants that thc patty of the first part has not done or suffered anything whereby thc said premises have been encumbered in any way whatever, except as aforesaid. AND the party of thc first part, in compliance with Scction 13 of the Lien Law, covenants thai the party of thc first part will ~ceive the consideration for this conveyance and will hold thc righl Io receive such consideration as a trust fund to be applied first for the purposc of paying thc cost of the improvement and will apply the same first to thc payment of the cost of the improvement before using any part oftbe total ofthe same for any other purpose.
