ALL that certain plot, piece or parcel of land, with the buildings and impmvemenls thereon
erected, situate, lying and being at F.~t Marion, Town of Southold, County of Suffolk and
State of New York, bounded and dLw.:ribed as follows:
BEGINNING at a point on the northeasterly side of a private road known as Circle Drive al
the southwesterly comer of land of Schaumberg;
RUNNING THENCE along said northerly side of Circle Drive, South 52 dc'grees 32 minutes
West, 57.5 feet to land formerly of Hitchcock;
THENCE along said land and along land formerly of Ketcham, North 8 dagrcus 58 minutes 20
seconds West, 166.58 feet to land vow or formerly of Schaumberg;
THENCE along said land the following two courses and distances:
(1) North 75 degrees 26 minutes 40 seconds East. 45.0 feet; and
(2) South 11 degrees 15 minutes 20 seconds P~s~, 143.65 feet to the northwesterly side of
Circle Drive nnd the point or place of BEGINNING.
TOGETHER with a right 6f w~'y 50 'feet in width over said Circle Drive along the
· southeasterly boundary of the premises and extending thence norfl~nsterly and then northerly
about 350 feet to Aquaview Avenue also extending southwesterly from the premises and thence
northerly about 600 feet to said Aquaview Avenue.
Also a right of way over a certain strip of land running from Aquaview Avenue to Long Island
Sound, more particularly described ns follows:
BEGINNING at a stake on the northerly line of Aquaview Avenue and distant 4~0 ~et easterly
from the easterly line of Rocky Point Road measured along said northerly line of Aquview
Avenue;
RUNNING THENCE North 7 degrees 10 minutes 10 seconds West, 260 feet, more or less, to
Long Island Sound;
THENCE easterly along said Long Island Sound 59 feet, more or less:
THENCE South 4 degrees 10 minutes 10 seconds East, 280 feet, more or less, to said
northerly line of Aqueview Avenue;
THENCE along said northerly line of Aquaview Avenue, North 83 degrees 10 minutes 10
seconds West, 45 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 12/2/66 and recorded on 12/'2/66 in the Office of the Suffolk County Clerk in Liber
6087, Page 338.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND thc party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first pa.q, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose ofpaying the
cost of the improvement and will apply the same first to thc payment of the cost of the
improvement before using any part oftbe total ofthe same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense ofthis indenture so
requires.
