THIS INDENTURE, made the or~' ~ day of June, in the year Two Thousand

party of the first part, and
NICHOLAS BABALIS and HELEN BABALIS, husband and wife, both residing at 3360 Rocky
Point Road, East Marion, New York 11939
party of the second part,
WlTNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second paxt, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being at East Marion,
Town of Southold, County of Suffolk and State of New York, bounded and described as
follows:-
BEGINNING at the northwesterly comer of the hereinafter described premises at the
northeasterly comer of land now or formerly of Judith C. Anarell-Wood;
RUNNING THENCE North 88 degrees 49 minutes 00 seconds East along land now or
formerly of Constantine Vangelatos, 134.64 feet to land now or formerly of Julie Kyrkostas;
THENCE South 12 degrees 08 minutes 40 seconds East along the last mentioned land and
along land now or formerly of Betas Excavating & Construction Company, Inc. 344.82 feet to
land now or formerly of Michael Hartofilis;
THENCE South 77 degrees 51 minutes 20 seconds West along the last mentioned land 152.84
feet to land now or formerly of John H. Prizeman;
THENCE North 08 degrees 57 minutes 10 seconds West along the last mentioned land and
along land now or formerly of Angelos Zompakos, Marionn I. Poulis, Craig Richter, Nicholas
Babalis and Judith C. Anarell-Wood, 370.99 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE part of the premises conveyed to the party of the first part
by deed from Ersilia Woods dated October 15, 1997, and recorded in the Suffolk County
Clerk's Office on November 26, 1997, in Liber 11864 page 738.

This conveyance intends and does hereby merge the abolie-described parcel with the title to that
parcel ownedby the party of the second part and desigmited on the Suffolk County Ta~ Map as
District 1000, Section 021, Block 04, Lot 009.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETI-I~R
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
