w TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and
all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
1 AND the parry of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
4 part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
crust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "partie ' henever the sense of this indenture so requires.

PARCEL 1
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying
and being at East Marion in the Town of Southold, County of
Suffolk and State of New York and bounded and described as
follows:
BEGINNING at a point on the easterly line of Rocky Point
Road, distant 540.89 feet southerly from a monument set at
the northwesterly corner of land of Persa Athans ad the
southwesterly corner of land of Andrew Dzenkowski, said
point of beginning being also the southwesterly corner of
lands quit-claimed by Persa Athans to John Yandaki by deed
dated November 15, 1952 (now lands of Nicholas Nicolelis and
Athanasia Nicolelis, his wife) ;
RUNNING THENCE in a general easterly direction along land
last mentioned to land of Muir Brothers, formerly of John M.
Griffing;
RUNNING THENCE in a general southerly direction along land
last mentioned, 40 feet to a point;
RUNNING THENCE in a general westerly direction and parallel
with and at all points distant 40 feet from the northerly
line of the premises herein described to a point on the
easterly line of Rocky Point Road;
RUNNING THENCE in a general northerly direction along the
easterly line of Rocky Point Road, 40 feet to the point or
place of BEGINNING.

ALL that certain piece or parcel of land, situate at East
Marion in the Town of Southold, Suffolk County, New York,
bounded and described as follows:
BEGINNING at a point on the easterly side of Rocky Point
Road, distant 3 , 798 .7 feet, more or less, northerly from the
corner formed by the intersection of the northerly side of
Main Road (New York State Route 25) and the easterly side of
Rocky Point Road;
RUNNING THENCE along the easterly side of Rocky Point Road,
north 8 degrees 59 minutes 50 seconds west, a distance of 70
feet;
RUNNING THENCE north 83 degrees 17 minutes 40 seconds east,
a distance of 334. 59 feet to land now or formerly of Muir;
RUNNING THENCE along land now or formerly of Muir, south 11
degrees 15 minutes 30 seconds east, a distance of 70. 17 feet
to land now or formerly of Persa Athans;
RUNNING THENCE along land now or formerly of Persa Athans,
south 83 degrees 17 minutes 40 seconds west, a distance of
337 . 38 feet to the easterly side of Rocky Point Road at the
