Suffolk County Center, Center Drive, Riverhead, New York 11901,

Resolution NUmber 1203-2002 adopted by the Suffolk County
Legislature on December 17,2002 and, thereafter, approved by
the.County Executive on December 20,2002, in consideration of
ten dollars and other valuable consideration paid by the party
of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors end assigns
of the party of the second part forever,
ALL, that certain plot, piece or parcel of land with any
buildings and improvements thereon erected, situate, lying ~nd
being in the Town of Southold, County of Suffolk and State of
New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as District 1000, Section 022.00,
Block 02.00, Lot 023,000, and acquired by Tax Deed on May
16,1997, from John C. Cochrane, the County Treasurer of Suffolk
County, New York and recorded on May 23,1997, in Liber 11832,
CP 317, and otherwise known as and by Town of Southold, N x now
or formerly Caravanos, E x Stars Road, S x now or formerly
Thalassinas, W x now or formerly Kapassas,
A~D the premises described herein shall not be independently
inm~roved by the erection of any structure, and can be merged
with grantee's adjoining parcel if a~licable so as to form one
single lot. There can be no further subdivision of the merged
parcel unless it is consistent with local town and/or village
zoning codes and standards of the Suffolk County Department of
Health Services, applicable at the time application is made.
TNXS restrictive covenant shall he enforceable by the County
of Suffolk by injunctive relief or by any other remedy, in
equity, or at law. The failure of the County of Suffolk or any
agency thereof to enforce this covenant, shall not be deemed to
impose any liability whatsoever upon the County of Suffolk or
any officer, employee or agent thereof.
T~IS covenant and restriction shall run with the land and
shall be binding 'upon the grantee, its successor and assigns,
and upon all persons claiming under them.
TO~ET~ with all right, title and interest, if any, of the
party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines
thereof;
TO~ET~ with the appurtenances and all the estate and
rights of the party of the first pa~t in and to said premises;
TO ~A~ A~D TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns
of the party of the second part forever.
UUB~E(:T to all covenants, restrictions and easements of
record, if any.
A~D the party of the first party, in compliance with Section
13 of the Lien Law, hereby covenants that the party of the
first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a
trust fund to be applied first for the ~ur~ose of paying the
cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any ~art of
the total of the same for any other purpose.

whenever the sense of this indenture so requires.
