JOHN TRIKOUKAS, residing at 105 Cedar Drive, East Marion, New York 11939, as surviving
tenant by the entirety
party of the first part, and
KATHY T. HALLIWELL, residing at 1500 Aquaview Avenue, East Marion, New York 11939
party of the second part,
WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being at East Marion, Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:-
BEGINNING at a point on the southerly side of Aquaview Avenue, North 67 degrees 14
minutes 00 seconds East, 122.68 feet to land of Costas Stars; running
THENCE along said land of Stars, South 10 degrees 46 minutes 00 seconds East, 225.51 feet;
running
THENCE along land of Theodoros Stamos on a line at right angles to said easterly side of
Cedar Drive, South 79 degrees 14 minutes 00 seconds West, 120 feet to said easterly side of
Cedar Drive; running
THENCE along said easterly side of Cedar Drive, North 10 degrees 46 minutes 00 seconds
West, 200.00 feet to the point or place of BEGINNING.
TOGETHER WITH a right of way over a certain strip of land running from Aquaview Avenue
to Long Island Sound, more particularly described as follows:-
BEGINNING at a stake on the northerly line of Aquaview Avenue and distant 490 feet easterly
from the easterly line of Rocky Point measured along said northerly line of Aquaview Avenue;
running
THENCE North 07 degrees 10 minutes 10 seconds West, 260.00 feet, more or less, to Long
Island Sound;
THENCE easterly along said Long Island Sound, South 59.00 feet, more or less;
THENCE South 04 degrees 10 minutes 10 seconds East, 280.00 feet, more or less, to said
northerly line of Aquaview Avenue;
THENCE along said northerly line of Aquaview Avenue, North 83 degrees 10 minutes 10
seconds West, 45.00 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
and Maria Trikoukas, now deceased, by deed from Theodoros Stamos dated April 4, 1962,
and recorded in the Suffolk County Clerk's Office on April 10, 196, in Liber 5150 page 66.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
