BEING THE SAME PROPERTY conveyed m the party ofthe first part by deed
dated January 23, 1960 ofM. Alft~l Lure and Joseph M. Rose recorded in the Office of
the Clerk of Suffolk County on January 25, i 960 at Liber 1759, Page 255 and therein
described as follows: "BEGINNING at n point on the southerly linc of a 33 foot private
road known as South View Drive, at the northwesterly oomer ofland conveyed by the
party of the f'u-st part to Bauer, running thence along the last described land, south 41
dag~ns 21 minutes 50 seconds east, 163.66 feet to the land of Droskoski~ thence along
said land of Droskoski, south 60 degrees 48 minutes west, 100 feet to land conveyed by
the parties of the first part to Rohloff; thence along the last described land. north 4 I
degrees 21 minutes 30 seconds west, 163.71 feel to the southerly line of said South View
Drive; thence along said southerly line of South View Drive, north 60 degrees 50 minutes
easL 100 feet to the point or place of beginning.
'TOGETHER with a right of way. and the right in common with others, to pass
and telXU~ over the streets, avenues and roads of Brown's Hills Estate Inc., dated July 5,
1955 and recorded in Liber 3923 ofdeeds at Page 165, July 7. 1955 to the Main Road
(Pt. 25).
"TOGETHER with the right to use, in common with others, solely for recreational
and not for commercial p~. ~e common lands of Brown's Hills Estates, Inc., ns
described in'the deed herein last above mentioned.
"SUBJECT to the following restrictions:
I. No building shall he erccted or permiund upon any portion ofsaid premises
other than a single, one-family detached dwelling house on a fully enclosed
(except for the necessary doors and windows) masomy foundation, of not
more than 1 ½ stories in height and containing within its exterior walls (not
'including porches or any attached gamae) on the ground floor not less than
750 square feet, or other than a private ~u-a&e and other nece~enry and proper
outbuildings (except privies) for the use of Ibc occupants of such dwelling
house.
2. No lot shall be less than 10,000 square feet.
3. That no fence or hedl~e shall be erected or permitted upon said premises
exeeedin$ 4 feet in height.
That no building or other structure, exeept a pump house, shall be elected or
pennittnd which, measured from its main foundation walls, shall be within 10
feet ofany lot, boundary or property line.
5. That no earth or mineral deposit shall be sold or removed except for the
proper grading and landscaping of the premises.
That the premises or any structures erected thereon shall be used solely for
residential pm'poses, and shall not at any time be used for the purpose of any
trade, manufuctur~ or business of any description or ns a school, hospital or
other charitable institution; nor shall anything be rnalntainnd, canied on,
suffered or permitted upon the premises or any part thereof which shall be
dangerous, noxious or offensive; provided, however, that the land may be
cultivated for private garden and landscape purposes.
7. That only such animals us are commonly considered ns the customary
domesticated pet type shall be kept on the premises;
which said restrictions shall run with the land and bind the parties nnd all future owners
thereof.
"SUBJECT, also, to other conditions, covenants, reservations end resections of
record, including those contained in an agreement dated September 22, 1956 between the
parties of the first part and the other sevcral owners of land or interests in land at Browns
Hills Estates.''

ALL that certain plot, piece or parcel of lund, with the buildings and
improvements thereon erected, situste, lying and being at Orient, Town of Southold,
County of Suffolk and State of New York, bounded and described us follows:
BEING THE SAME PROPERTY conveyed to the party of the first part by deed dated
January 3, 1969 of Anne MacKay and Carole M. Losee recorded in the Office ofthe
Cled~ of Suffolk County on Felmmry 6, 1969 at Liber 6502, Page 146 and therein

described ns follows: "BEGINNING at a point on the southerly line ora 33 foot private
wad known as South View Drive, at the northwesterly comer of land of the patly ofthe
second part: said point of beginning being also 405 feet westerly along said southerly line
fi*om the westerly line of another 33 font private road known as Brown's Hills Road;
from said point of beBioning running along land ofthe pa~y of the second part south 41 ~

deed from N. Alfred Luce and another m Brown's Hills Estates, Inc., dated July 5, 1955,
recorded July 7, 1955, in the Suffolk County Clerk's office in Liber 3923 of conveyances
at Page 165, to the Main Road (Route 25).
