HomeMy WebLinkAboutL 12256 P 6352__ THIS INDENTURE, made the / ~' day of November, Two Thousand and Two. ..~ ,~,/",~__.-~./TO~--..- ~,/~-~"'/.,/,E' ~',,~ ~-.,/]T/:: Of----- BETWEEN IRVING NEWMAN--'GEORGE NEWMAN, residing at I Horizon Road - Suite 1030, Fort Lee, New Jersey 07024, party of the first and ORIENT PARK ESTATES, LLC, a domestic corporation having an office for the transaction of business at 16 Pine Street, Walden, New York 12586, party of the second part, WITNESSETH, that the party of the first part, in consideration ofTEN DOLLARS and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second par~, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND, with the buildings and improvements thereon erected, situate, lying and being in Orient, Town of Southold, County of Suffolk and State of New York, known and designated as the Park and Playground area as shown on a certain map entitled, "Map of Perry's Bight at Orient, Town of Southold, County of Suffolk and State of New York", and filed in the Office of the Clerk_of the County of Suffolk on January 26, 1973 as Map No. 5859'and rei;ere~eed as Section 14; Block 2; Lot 7.2 .... George Newman having died testate, a resident of Suffolk Counly on November g, 1985. Being and intended to be a part of the same lands and premises as conveyed to thc party of the first part in Liber 6041 page 584 in the office of the Suffolk County Clerk. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of thc second part forever. TOGETHER with an easement for ingress and egress over Petty's Drive and Bight Road to the nearest public highway. AND the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with §13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
