party of the first part, and THOMAS L. GATZ and DIANE K. GATZ, his wife, both residing at 119 Stephen
Drive, Wading River, New York 11792
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN and no/10Oths ($10.00) dollars paid by
the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, County of
Suffolk and State of New York, known and designated as Lot 8 on a certain map entitled 'Map of Golden View
Estates', and filed in the Office of the Clerk of the County of Suffolk on August 30, 1984 as Map No. 7770; said
lot being bounded and described as follows:
BEGINNING at a stake on the northwesterly side of Eagle Nest Court distant northeasterly 426.27 feet from
the extreme easterly end of the curve which connects the northeasterly side of White Eagle Drive and the
northwesterly side of Eagle Nest Court;
RUNNING THENCE North 32 degrees 33 minutes 42 seconds West, 263.31 feet to a stake;
THENCE North 57 degrees 26 minutes 18 seconds East, 165.65 feet to a stake and land now or formerly of
Nicolo and Caroline Debartolo;
THENCE South 44 degrees 56 minutes 47 seconds East along said last land, 69.95 feet to a monument;
THENCE South 26 degrees 36 minutes 42 seconds East, 188.32 feet to a stake set on the northwesterly side
of Eagle Nest Court;
THENCE Southwesterly along said northwesterly side of Eagle Nest Court the following three (3) courses and
distances:
(1) along an arc of a curve bearing to the left having a radius of 390.00 feet, a distance of 78.99 feet;
(2) South 51 degrees 47 minutes 03 seconds West, 50.20 feet; and
(3) Along an arc of a curve bearing to the right having a radius of 1980.00 feet, a distance of 32.44 feet to the
point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed from
GOLDEN VIEW ESTATES, INC. dated July 1,1999 and recorded July 13,1999 in Liber 11975 cp 397.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
Whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word 'party" shall be construed as if it read 'parties' whenever the sense of this indenture so
requires.
