THIS INDENTURE, made the 22nd day of June, Two Thousand Five
BETWEEN
ANTHONY BARBARISE and CHRISTINE BARBARISE, his wife, residing at 240 County

WITNESSETH, that the party of the first pan, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second pan, does hereby grant and release unto the party of
the second pan, the heirs or successors and assigns of the patty of the second pa. forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York. known and designated as Lot//45 on a certain map entitled "Map of Green Acres at
Orient' at Southold and filed in the Office of the Clerk of the County of Suffolk on April 13,
1962 as Map No. 3540, said lot being bounded nmi described as follows:
BEGINNING at a point on the westerly side of Greenway East (a privau~ road) distant 634.26
feet southerly from the comer formed by the intersection of the southerly side of North Sea
Drive with the westerly side of Greenway East;
THENCE along the westerly side of Oreenway East (a private road) the following two (2)
courses and distances:
1) South 0 degrees 27 minutes 50 seconds East, 93.22 feet;
2) South 6 degrees 48 minutes I0 seconds East. 61.00 feet;
THENCE South 83 degrees 11 minutes 50 seconds West, 134.00 feet;
THENCE North 2 degrees 21 minutes 20 seconds West, 168.73 feet;
THENCE North 89 degrees 32 minutes 10 seconds East. 132.00 feet to the westerly sidc of
Greenway East (a private road) sand the point or place of BEGINNING.
ItEING AND INTENDED TO BE the same premises conveyed to the party of the first pan by
deed from Mary M, O'Hanlon. dated 7/!/1997, and recorded 7191997, in the Office of the
Suffolk County Clerk in Libex 11839, Page 745.
TOGETHER with all right, fMc and interest, if any. of the party of the first pm1 in and to any
sU'eets and roads abutting the above described p,cmises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
pretnisns; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
pa~, the heirs or successors and assigns of the party of the second part forever.
AND thc party of thc first part covenants that the party of thc trust pat has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the fi~t i~ut, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the pu_tpnse of payillg the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other puq~ose.
The word "party' shall be construed as if it read "pmies" whenever the sense of this indenture so
requires.
