THIS INDENTURE, made the 15'~ day of Novcmber, Two Thousand Four
BETWEEN
JOHN M. EBERHARDT, residing at 730 Grcenway West, Orient, New York 11957,
purty ofthc first part, and
CHRISTOPHER LOWERY and CHARLENE LOW. ERY, husband and wife, residing at 20
Sargent Place, Manhasset, New York 11030,
party of the second p-art,
WITNESSETH, that thc party of the first part, in consider~tinu ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
ortho second pan, the heirs or succe~____~ors and assigns orthe party of the second pan forever,
ALL that certain plot. piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in rite Town of Somhold, County of Suffolk and State of New
York, known as Lot No. 36 as shown on a certain map entided, "Map of Green Acres, West
Orient," and filed in the Office of the Clerk of the County of Suffolk on April 13, 1962 as
Map No. 3430. being more particularly bounded and described as follows:
BEGINNING at a point on the easterly side of Greenway West distant 539.26 feet southerly
from the comer formed by the intersection of the easterly side of Greenway Wes! and the
southerly side of North Sea Drive;
RUNNING THENCE North 85 degrees 24 minutes 40 seconds East, 126.42 feet;
THENCE South 2 degrees 21 minutes 20 seconds East, 168.73 feet;
THENCE South 85 degrees 24 minutes 40 seconds Wast, 119.84 feet to the easterly side of
Greenway West; and
THENCE North 4 degrees 35 minutes 20 seconds West along the easterly side of Greenway
West, 168.60 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the fa'st pan by
deed from Peter O'Hanlon, dated May 18, 2000, and recorded June 2, 2000, in the Office of
the Suffolk County Clerk in Liber 12046, Page 4:53.
TOGETHER with all right, title and interest, il'any, of thc party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first pan in and to said
premises; TO HAVE AND TO HOLD the premises herein grant~l unto the party of the second
part, the heirs or successors and assigns of the party of the second pan forever.
AND the party ofthe first pan covenants that the party of the first pan has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first pan, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive thc consi&ration for this conveyance and will hold the
risht to receive such consideration as a trust fund to be applied first for thc purpose ofpaying the
cost of thc improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total ofthe same for any other purpose.
The word "party" shall be conslrued as il'it read "panics" whenever the sense of this indanmre so
requires.
