The property is approximately 3.4 acres and is located on the site of the former General Wayne Inn, Cedar Beach Road, Southold, New York. III. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thcreof other than the part so decided to be tmconstitutional or invalid. IV. EFFECTIVE DATE This Local Law shall take effect immediately afier filing with the Secretary of State as General Wayne Change of Zone Public Hearing 2 July 1,2008 provided by law. ASSISTANT TOWN ATTORNEY CORCORAN: Actually it is currently HB and AC. It is being changed to R80. COUNCILMAN WICKHAM: I am sorry, that is right. It is currently Hamlet Business and AC, the change would make that a change to R80. I believe that this piece of property is where the General Wayne Inn stands and has for many years. I have other notices here, a notice from the Suftblk County Planning Department, Department of Planning. 'Pursuant to the requirements of Chapter, section A 1414 of the Suffolk County administrative code, this application which has been submitted to the Planning Commission is considered to be a matter of local determination as there is no apparent significant county wide or inter community impact.' And ! have a short environmental assessment for a list of actions filed and I have a recommendation here from Mark Terry, the principal planner and the LWRP coordinator dated June 30th. 'The proposed local law has been reviewed according to Chapter 268 and the LWRP policy standards. Based upon the information provided, the recommendation: the policy is consistent with the policy standards and therefore is consistent with LWRP.' I have another memo dated June 25~h from the chair of the Southold Town Planning Board. 'The Planning Board has reviewed the proposed zone change and supports it. Please see the attached memo from the Planning Board dated February 6Ih which includes a brief history of the parcels zoning designations and our recommendations' and it is like a three or four page letter. I will just read very briefly at the end. the Planning Board recommendations at that time. 'The Planning Board recommends changing the zone of the entire parcel to RS0 residential based on the following findings. 1. The subject parcel is entirely surrounded by residential development and residential zoning. 2. The rezoning of this property is consistent with the zoning designation of the parcel surrounding on three sides. 3. The R80 zone designation will result in less intense and more compatible land uses than permitted in the current HB zoning district.' I have a notice that it has appeared as a legal on the Toxvn Clerk's bulletin board and I have before me the copy from the Suffolk Times legals. Those are the only comments that I find in the file. SUPERVISOR RUSSELL: Okay. I just want to clarify for everybody's edification. This is about a little over 3 acres where the historic General Wayne stands in Southold. I had actually put that on the agenda several months ago to consider a change of zone. Currently, where the facility is, where the General Wayne is, it is zoned hamlet business. The property in the back is zoned AC. Back in 1989, when that zoning map was adopted, I think there was an effort to match the zoning to the use at that time. That building, where it still functional, might make sense to leave as [lB to continue to allow someone to operate it, that building is beyond repair. It is no longer functional and to leave a hamlet business zoning in the middle of a sea of residential and preserved area makes no more sense than a residential parcel in the middle of the hamlet of Southold right in the business section. So, that is one of the little things that the Town Board needs to clean up from time to time. Would anybody like to address the l'own Board on the issue of the rezoning? General Wayne Change of Zone Public Hearing 3 July 1, 2008 MELANIE NORDEN: Melanie Norden, Greenport. Actually, I don't know anything about the background of this. This was something generated by the Town Board? SUPERVISOR RUSSELL: I had put it on the agenda, 1 would say almost a year ago. MS. NORDEN: Okay and does the current property owner have any intention of doing anything with the property? SUPERVISOR RUSSELL: The property right now sits with the County of Suffolk. They are the title holder. It was taken as a consequence of a tax sale. I don't know if they will work with the previous owner to redeem the property but currently, under the tax roll, Suffolk County is the owner of record. MS. NORDEN: Okay. Since it is sited in a rather environmentally sensitive area, sort of in front of Cedar beach, I believe, have you considered preserving it? Purchasing it? SUPERVISOR RUSSELL: We certainly would, if that offer was made to the Town, we would certainly... MS. NORDEN: But you don't have to have an offer. You can go after it. SUPERVISOR RUSSELL: No, you can't. Not when the county owns it, under a redemption period. Everything would need to be done through resolution for the county of Sufl61k. MS. NORDEN: Can you do that though? I mean, would you consider doing that? SUPERVISOR RUSSELL: It would depend on their redemption agreement with the previous owner. In other words, I don't know how long they have given him to redeem taxes but we are aware of it. I have already talked to the county about, I already talked to our representative from the county parks about it, to make it park land. There was actually, someone had come out to me from the county about a year or so ago. I had proposed the: idea of putting affordable housing there. I didn't speak to the Board about it but I told the person at the time that is not a use that would be consistent with our issues or with our planning goals, which is the halo's and that is so far outside the halo that aflbrdable housing in that site probably wouldn't work but certainly as a park they know we are certainly interested in that. MS. NORDEN: Department? And have you spoken to Melissa and the Town Preservation SUPERVISOR RUSSELL: No need to yet. We wouldn't buy it from the county, they would otter it to us for use as a park. SUPERVISOR RUSSELL: It is up to the county and how they want to dispose of it. You know, everything is a county decision. MS. NORDEN: But could you notify the county that we are interested? The amendment is consistent with the comprehensive planning practiced in the Town, and serves to prevent the property from being developed in a manner incompatible with our planning efforts and the surrounding land uses. The parcel, also known as the site of the former General Wayne Inn in Southold, is currently zoned half Hamlet Business (HB), due to its historic use as an inn, and half Agricultural Conservation (AC), the zoning district adjacent to the south and west. The property is no longer used as an inn, and the condition of the inn building has been allowed to deteriorate. The parcel's current zoning district, Hamlet Business, was apparently applied to this property to allow the historic use of restaurant and inn. With the historic use discontinued, the future use of the property must be considered. The Han~let Business zone is intended for higher-intensity commercial use in the hamlet business center. This property is deeply embedded in a residential community located far from the hamlet center and any other commercial zoning. Many of the allowable uses in the Hamlet Business zone are incompatible with single family low-density residential neighborhoods. Over the years the trend has been to restrict the zoning on this property. On the original zoning map in 1957, the entire 3.4 acres was zoned "B" Business. By 1972, the zoning map shows the parcel ioned as "M-I" General Multiple Residence over only half the property, while the rest became "A" Residence (1-acre residential). This was reaffirmed in the town-wide zoning map update of 1989, when the property was zoned "HB" Hamlet Business over the portion that was formerly M-1, and A-C (Agricultural, 2-acre residential) over the remainder formerly A- Residence. Page Two - Zoning Recommendation The Town has consistently resisted further down-zoning on this property. The property was before the Town Board for a change of zone application in May 6, 1980 (see attached minutes from the public hearing) to change the "A-Residence District" on half the property to the "M-1 General Multiple Residence District", with the proposal to build a townhouse condominium project. The Town Board did not grant that zone change (the proposal included another three acres to the east). On March 9, 2006, the Zoning Board of Appeals denied area variances requested for proposed lots in a subdivision of the property, the effect of which would have been to increase the yield on the property by one lot, from three to four, and decrease the minimum lot size on in the AC district (see attached ZBA decision). The Planning Board recommends changing the zone of the entire parcel to R-80 Residential, based on the following findings: 1. The subject property is entirely surrounded by residential development and residential zoning districts. 2. The rezoning of the subject property is consistent with the zoning designation of the parcels surrounding on three sides; R-80 to the north, (80,000 s.f. minimum lot size), Agricultural Conservation to the south and west (also 80,000 s.f. minimum lot size). 3. The R-80 zoning designation will result in less intense and more compatible land uses than permitted in the current Hamlet Business zoning district. The public and the community will benefit from this change of zone by eliminating the possibility of an incompatible use being introduced into the neighborhood. There will also be public benefit in the form of environmental protection. An intense use on this property could potentially have an impact on the groundwater quality, and in turn, eventually affect the nearby surface waters. Further, potential commercial uses allowed in the HB zone often involve activities viewed as nuisances in residential neighborhoods such as noise, traffic, bright lighting, and track traffic. The rezoning of the subject property is consistent with the zoning designation of the parcels surrounding on three sides; R-80 to the north, (80,000 s.f. minimum lot size), Agricultural Conservation to the south and west (also 80,000 s.f. minimum lot size). 3. Based upon preparation of a full EAF (Part I and Part II) it has been determined that no significant environmental impacts will result from the proposed change of zone action and it is appropriate for the Town Board to adopt a Negative Declaration. Location and Site Overview The subject site is located on at the eastem terminus of South Bayview Road, at the southeastern comer of the intersection of Orchard Lane and Cedar Beach Road, Town of Southold, County of Page I General Wayne Inn, Southold SEQRA Review NP&V 008132 Suffolk. The subject property can be more particularly described as SCTM number 1000-89-03- 1.1. The site currently consists of the abandoned structure which is in a deteriorated state, surrounding landscaping and natural vegetation. Based upon a review of aerial photography, soil map, wetland map, topography map, groundwater map, watermain map, and flood zone map, the site does not appear to contain environmentally sensitive features. Additionally, the site does not contain any known historically and ecologically significant resources, although the site is depicted on the NYS Office of Parks, Recreation and Historic Preservation (NYS OPRHP) Circles and Squares Map as being located within an area with high potential for archaeological resources. This review will discuss the proposed zone change and its potential impact on the sites environmental resoumes, and more importantly the potential for inappropriate redevelopment of the site under the current zoning. Proposed Project The proposed action involves a change of zone HB Hamlet Business District and AC Agricultural Conservation District to R-80 Residential by the Town Board's own motion on a 3.4 acre parcel of land located in Southold. The change of zone is in response to the discontinued use of the General Wayne Inn, which was zoned to allow for the continued use of the inn. The site currently consists of the vacant structure, surrounding landscaping and natural vegetation. The Town Board has declared itself Lead Agency and finds the action to be an Unlisted Action pursuant to SEQRA Rules and Regulations. Land Use and Zoning The project site is located in an area that contains residential, vacant, and agricultural uses. The dominant land use in the general area is residential, and the proposed zoning is generally consistent with surrounding zoning and uses. Residential uses are located to the north, south, east and west of the subject site, in conjunction with some agricultural uses and vacant undeveloped land located along the Main Bayview Road frontage. The subject site is zoned HB Hamlet Business District and AC Agricultural Conservation District. The AC District requires a minimum lot size of 80,000 s.f., lot coverage of 20% of the lot area, and a minimum livable floor area of 850 s.f. per dwelling. The HB District requires a minimum lot size of 20,000 s.f. for business use or single family residential use. The proposed project involves a change of zone from HB Hamlet Business District and AC Agricultural Conservation District to R-80 Residential. For single family dwellings, the minimum lot size within the R-80 district is 80,000 s.f., with lot coverage of 20% of the lot area, and a minimum livable floor area of 850 s.f. per dwelling. The proposed zoning would allow for future development of the site which would be consistent with surrounding land uses and zoning. The subject parcel is located within an area which consists of low density residential uses. As such, and HB zoned lot is inappropriate here due to the potential for higher intensity use that an HB Page 2 General Wayne Inn, Southold SEQRA Review NP&V #08132 zoned district creates, It is recognized by thc Town that thc current zoning of this site was due to the existence of the General Wayne Inn. R-80 zoning is located to the east, while AC zoning is located to the north and west of the site and are the dominant zoning designations in the general area. A smaller area of R-40 zoning is located to the south of the site (see Figure 1 which illustrates current zoning in the area). AC and R-40 zoning districts are located further north and northwest of the subject site. With respect to land use, the proposed change of zone would allow for similar use as the residential development in the surrounding area and will consist of comparable lot sizes with those developments. It is expected that the property will yield only one home since four acres would be required to allow for two homes. As the change of zone is comparable to that of the majority of the current zoning of the subject site, and the change of zone will result in a reduction in the development potential of the site, no land use or zoning impacts are expected. Traffic Generation Redevelopment under R-80 would be expected to decrease traffic as compared to redevelopment under the current zoning. As the proposed use would be residential, only trips related to that residence would be generated, which would be less than the trips generated by the prior commercial use. Soils and Topography The site is relatively flat throughout, with all existing slopes between approximately 0-10%. The property does not contain any significant landforms or geological features. The Suffolk County Soil Survey (Warner, 1975) identifies one soil type on the subject site, Riverhead sandy loam, 0 to 3% slopes (RdA). The Riverhead series consists of deep, well-drained moderately coarse textures soils that formed a mantle of sandy loam or fine sandy loam over thick layers of coarse sand and gravel (Warner, 1975). The soil survey lists the erosion hazard for RdA as slight and the main concerns of management involve controlling runoff and erosion and providing adequate moisture for landscaping/agriculture. The topography and soils on site do not appear to present severe development constraints with respect to home site development. Wetlands The site does not contain any NYSDEC designated freshwater wetlands, nor does it contain wetlands designated by the Federal National Wetlands Inventory Map prepared by the U.S. Fish and Wildlife Service. The nearest NYSDEC regulated wetland is located west of the site and on the north side of South Bayview Road, (NYSDEC freshwater wetland SO-44). The NYSDEC regulates those activities within 100 feet of a freshwater wetland boundary, as regulated under Article 24 of the ECL. It Page 3 General Wayne Inn, Southold SEQRA Review NP&V #05132 appears that the subject property is located more than 100 feet east of the regulated wetland. There are no tidal wetlands on the subject site, however, Cedar Beach Creek is located to the east of the subject site. The NYSDEC regulates those activities within 300 feet of a tidal wetland boundary, or to the 10 foot contour, as regulated under Article 25 of the ECL. Portions of the subject property are located within 300 feet of a tidal wetland boundary, so future development of the property would be subject to NYSDEC regulations and new construction may require that a tidal wetlands permit be obtained. Water Resources Public water is supplied to the general area by the Suffolk County Water Authority, and the subject site is connected to public water. Any future development of the site would be connected to public water. In 1978, the Long Island Regional Planning Board published the Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying groundwater flow patterns and water quality. The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. Therefore, the allowable nitrogen bearing flow for the overall 3.4 acre site is 2,040 gpd. Any future development would be required to conform to this standard. Design flow for a single family residence is 300 gallons per day; therefore development under the proposed R-80 zoning will conform to Article VI. The elevation of groundwater beneath the subject site is approximately 5 feet above mean sea level (msl) according to the 1999 SCDHS water table map. The topographic elevation on site is approximately 10 feet above msl, based on the USGS topographic map. Therefore, the minimum depth to groundwater is approximately 5 feet. The depth to groundwater on site may have constraints on the location of septic systems for future development. A standard, three pool septic system typically requires a minimum depth to groundwater of approximately 9-10 feet to allow adequate depth for leaching. SUMMARY In conclusion, the proposed change of zone would create one residential lot consistent with development in the vicinity. The site does not appear to contain significant environmental features that would limit residential development, provided adequate drainage and containment of on-site runoff are achieved and sanitary systems are properly designed and constructed. In contrast, redevelopment of the property under Hamlet Business District zoning could result in an inappropriate density for this area with potential impacts to groundwater, traffic, and community character. The change of zone on the Board's own motion will not have an environmental impact and therefore a Negative Declaration is recommended for this action.
