GAGEN, residing at 4415 Westphalia Road, Mattituck, New York 11952 I,' party of the second part, WITNESSETH, that the party of the first part, in consideration of dollars paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, Iyingandbeinginthe Village of Mattituck,Town of Southold,County of Suffolk al State of New York, bounded and described as follows: BEGINNING at a concrete monument on the southerly line of Westphalia Avenue at the northwesterly corner of land of William T. and Wilma Snyder; RUNNING THENCE along land of Snyder, South 29 degrees 42 minutes 50 seconds East 258.96 feet to a concrete monument; THENCE along other land of the party of the first part, South 63 degrees 53 minutes 10 seconds West 100.23 Feet to the land of Frank Tuthill; THENCE along said land of Frank Tuthill, North 29 degrees 32 minutes 00 seconds West 265.39 feet to an iron pipe on said southerly line of Westphalia Avenue; THENCE along said southerly line of Westphalia Avenue, North 67 degrees 35 minutes 20 seconds East 100.00 feet to the point of beginning. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated August 7, 2000 and recorded in the Office of the Clerk of Suffolk County on August 8, 2000 in Liber 12061 of Deeds at page 520. FREDERICK D. TAYLOR retains a Life Estate TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AN D the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other pu~)ose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so requires.
