being at Marratooka Point at Mattituck in the Town of Southold, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at a monument set on the northeasterly line of Bungalow Road, 136.48 feet southeasterly along said line
from the southeasterly corner of I,md conveyed by Wilsberg to Kopf (1971);
RUNNING THENCE along land now or formerly of J. Parker Wickham, three courses:
(I) N. 1033' E. - 30.0 feet; thence
(2) S. 880 27' E. - 65.0 feet; thence
(3) N. 220 15' E. - 110 feet, more or less, to ordinary bigb water mark of Deep Hole Creek;
THENCE southeasterly along said bigh water mark, 45 feet, more or less, to other land now or formerly of Frederick
A. Ross;
THENCE along said land now or formerly of Ross, two courses:
(I) S. 2ZO 15' W. - 180.0 feet, more or less; thence
(2) S. 110 05' W. - 25.0 feet;
THENCE along said land now or formerly of Ross and land now or formerly of Wuttke, N. 450 43' W. - 82.85 feet
THENCE along said land now or formerly of Wuttke, N. 410 00' W. - 59.07 feet;
THENCE S. 880 27' E. - 31.0 feet to the point of BEGINNING.
SUBJECT to a rigbt of way over an existing traveled road across the premises;
SUBJECT to an easement recorded on Marcb 24, 1995 by the Suffolk County Clerk at Libel' 11719 page 301;
TOGETHER with a terminable easement to travel on foot over a right of way as recorded on October 25, 1994 by the
Suffolk County Clerk at Libel' 11699 page 843.
BEING AND INTENDED TO BE the same premises described in the deed of the parties of the first part berein by deed
from 1. Parker Wickham, dated November 16. 1976, recorded in the Suffolk County Clerk's Office on December I, 1976,
in Libel' 8150, Page 532.
TOGETHER with all rigbt, title and interest, if any, of the party of the first part in and to any streets and roads abutting
Ihe above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate and
rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto
tbe party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part bas not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will bold the right to receive sucb consideration as a trust fund to
be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the
<:ost of improvement before using 'my part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" wbenever the sense of this indenture so requires.
