WITNESSETH, that the party ofthe first part, in consideration ofTen Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel ofland, with the buildings and improvements thereon erected, situate, lying
and being
at Mattituck, Town of Southold, County of Suffolk and
State of New York, described as follows:
BEGINNING at a monument set at the extreme northerly
point of the arc of a curve that connects the westerly side of
Cox Neck Road and the northerly side of Sound Avenue;
RUNNING THENCE southwesterly along said arc of a curve,
said arc of a curve having a radius of 66.50 feet, a distance
of 127.69 feet to a monument;
RUNNING THENCE along the northerly side of Sound Avenue,
South 87 deg. 46 min. 50 sec. West, (375.00 feet deed) (337.83
feet actual) to land now or formerly.of Bissett;
RUNNING THENCE along said lands, North 02 deg. 13 min.
10 sec. West, 400.00 feet to land now or formerly of Bissett;
RUNNING THENCE along said lands, North 67 deg. 47 min. 40
sec. East, 270.00 feet to the westerly side of Cox Neck Road;
RUNNING THENCE along said road, South 22 deg. 12 min. 20
sec. East, 428.85 feet to the northerly end of the curve, at
the point or place of BEGINNING.
SUBJECT TO all instruments of record.
BEING AND INTENDED TO BE the same premises conveyed to
Granto~ by deed dated 2/2/89 and recorded 2/16/89 in Liber
10800 page 42.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost ofthe improvement and will apply the same
first to the payment ofthe cost of the improvement before using any part of the total of the same for any other
purpose. .
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
