THIS INDENTURE, made the/~Ph day of July, two thousand BETWEEN DANIEL NOCERA, residing at 327 Oceanside Street, Islip Terrace, New York party of the first part, and , CHRISTOPHER NOCERA, residing at 327 Oceanside Street, Islip Terrace, New York party of the second part, WITNESSETH, that the party of the first part, in consideration often Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Mattituck, Town of Southold, County of Suffolk and State of New York, known and designated as Lot No. 44 on a certain map entitled, "Map of Subdivision for Mattituck Estates, Inc., Mattituck, Town of Southold, Suffolk County, New York", and filed in the Office of the Clerk of the County of Suffolk on September 8, 1965 as File No. 4453, being bounded and described as follows: BEGINNING at a monument on the easterly side of Meadow Lane distant 77.95 feet northerly from the extreme northerly point of an arc of a curve, said am of a curve has a radius of 60.66 feet and a length of 83.64 feet and connects the easterly side of Meadow Lane and the northerly side of New Suffolk Avenue, said point of beginning also being at the division line between Lot 4 and Lot 45 as shown on said aforementioned map; RUNNING THENCE along the easterly side of Meadow Lane North 3 degrees 54 minutes 00 seconds West 125.00 feet to a monument; RUNNING THENCE along the division line between Lot 44 and Lot 43 North 86 degrees 06 minutes 00 seconds East 165.70 feet; RUNNING THENCE along the land now or formerly of C.B. Melot South 12 degrees 28 minutes 10 seconds West 30.70 feet to a monument; RUNNING THENCE along the land now or formerly of R.D. Tuthill South 10 degrees 49 minutes 00 seconds East 96.25 feet to a monument; RUNNING THENCE along the division line between Lot 44 and LOt 45 South 86 degrees 06 minutes 00 seconds West 168.65 feet to a monument on the easterly side of Meadow Lane and the point or place of BEGINNING. Being and intended to be the same premises conveyed to the party of the first part by deed dated 9/11/85 and recorded in the Office of the Suffolk County Clerk on 9/20/85 in Liber 9879, cp 345. Said premises known as 925 MEADOW LANE, MATTITUCK, NEW YORK TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
