consideration of Ten Dollars and other valuable
consideration paid by the party of the second part,
does hereby grant and release unto the party of the
second part, the heirs or successors and assigns of the
party of the second part forever, in
All that certain plot, piece or parcel of land, with
buildings and improvements thereon erected, situate,
lying and being at Cutchogue, in the Town of Southold,
County of Suffolk and State of New York, which on a
certain map entitled, "Map of Eugene Heights owned by
Jacob F. Bowers, ,;ituate at Cutchogue, New York", filed
in the Office of the Clerk of the County of Suffolk as
Map No. 856 on October 29, 1928 and known and
designated as and by Lot Nos. 12 and 13, which lots
when taken together are bounded and described as
follows:
BEGINNING at a point on the easterly side of Oak Street
distant 730.72 fe!?t southerly from the intersection of
the southerly sid!? of pierce Drive with the easterly
side of Oak Street;
RUNNING THENCE North 82 degrees 01 minutes 10 seconds
East 167.87 feet to the westerly side of Eugene's
Creek;
THENCE along a tie line along the westerly side of
Eugene's Creek, South 35 degrees 22 minutes 55 seconds
East 70.14 feet;
THENCE South 86 d!?grees 40 minutes 00 seconds West
200.81 feet to the easterly side of Oak Street;
THENCE along the easterly side of Oak Street, North 7
degrees 58 minute:; 50 seconds West 46.00 feet to the

conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for
the purpose of paying the cost of improvement and will
apply the same first to the payment of the cost of the
improvement before using any part of the total of the
same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of
