THIS INDENTURE, made the 15th day of BETVVEEN JAMES WOLBERT, residing New York 11952 June1 2000 and at 1480 West Mill Road, Mactituck, party of the first part, and JAMES WOLBERT and LINDA WOLBERT, his wife, residing at 1480 West Mill Road, Mattituck, New York 11952 party of the second part, VVITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part. does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being irrthe- at Mattituck, Town of Southold, Suffolk County, New York, bounded and described as follows: 0~ BEGINNING at a monument on the easterly side of Mill Road at the northwesterly corner of the land of Robert and Karen Darin, formerly Stephen Stevens, which point of beginning is 544.71 feet southerly from the corner formed by the intersection of the southerly side of Bayview Avenue and the easterly side of Mill Road; (1) thence along the easterly side of Mill Road North 190 20' 20" East 135 feet; (2) thence South 700 39' 40" East 232.96 feet; (3) thence South 190 20' 20" West 77.29 feet to said land of Darin, formerly Stevens; (4) thence along said land North 840 34' 30" West 240.0 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of ,the first part by deed dated December 3, 1992 and recorded in the Suffolk County Clerk's Office on December 28, 1992 in Liber 11597 Page 9. This conveyance is being made subject to a mortgage held by The Suffolk County National Bank dated December 3, 1992 and recorded in the Suffolk County Clerk's Office in Liber 18481 Page 396 in the principal amount of $90,000.00 and the party of the second part hereby assumes and covenants to pay such mortgage with interest. TOGETHER with all right, title and interest. if any, of the party of the first part, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the part of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid.;:!_ AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the'"arty of the first part will receive the consideration for this conveyance and will hold the right to receive such consider- ation as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
