TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the st:cond part forever.
AND the party of the first part covenants that the party ofthe first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a Deust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other

The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

Description
AMENDED 3/29/00
ALL that certain plot, piece or parcel ofland, situate, lying and being at Mattituck, in the Town of Southold,
County of Suffolk arid State of New York, being known and designated as Lots 69 and 70 and the easterly
portions of Plots D and E on a certain map entitled, "Amended Map of Mattituck H~ights, property of Gustav
Bayer" and filed in the Office of the Clerk of the County of Suffolk on July 24, 1935 as Map No. 1184, which
said lots and Plots [) and E on said map, when taken together are bounded and described as follows:
BEGINNING at a monument set in the westerly line of Corklin Road, also known as Grant Boulevard, at the
division line between Lots 58 and 70 on said map, said point of beginning being distant 232.51 feet southerly,
when measured along the westerly line of Conklin Road (Grant Boulevard) from the southerly line of Bayer
Road;
RUNNING THENCE South 14 degrees 02. minutes 50 seconds East, along the westerly line of Conklin Road
(Grant Boulevard), 269.60 feet to land of the County of Suffolk;
THENCE South 24 degrees 47 minutes 30 seconds West along said last mentioned land, 193.62 feet to land
formerly of Pollock later of Susie H. Cooke;
THENCE North 19 degrees 32 minutes 50 seconds West along said last mentioned land, 306.43 feet to the
southerly I ine of Lot 69 on said map;
THENCE South 75 degrees 57 minutes 10 seconds West along said southerly line, 35.0 feet to the southeasterly
line of Lot 61 on said map;
THENCE North 31 degrees 04 minutes 30 seconds East along the southeasterly line of Lots 61 and 60 on said
map, 70.86 feet to a monument; .
THENCE North 15 degrees 40 minutes 40 seconds East along the southeasterly line of Lots 60 and 59 on said

THENCE North 75 degrees 57 minutes 10 seconds East along said division line, 98.23 feet to the point or place of
BEGINNING.
TOGETHER with the use of a right of way eight feet wide to and from Wickham Avenue to Long Creek, a
branch of Mattituck Bay to pass and repass on foot only; said right of way commencing at the northerly junction
of Middle Road and Wickham A venue, at a concrete monument, running in a westerly direction eight feet;
THENCE RUNNING in a northerly direction 130 feet parallel with the boundary line of property of Hubert W.
Klein and Gustav Bayer, to mean high water mark of Long Creek;
THENCE RUNNING in an easterly direction along Long Creek to land of Western boundary property of Hubert
W. Klein, 130 feet to a concrete monument, the northerly junction of Middle Road and Wickham A venue, the
point or place of BEGINNING.
TOGETHER with the use of a right of way known as Farm Road to pass and repass from Grant Boulevard to
Wickham Avenue.
TOGETHER with all the right, title and interest of the parties of the first part of, in and to land lying within the
