Cartoon, Esq., 33 McKeel Avenue, Tarrytown, NY 10591, party ofthe first part; and SUSAN CONNELL. residing at399 East72nd Street, New York, NY 10021, party of the second part; WHEREAS, the party of the first part has previously by her revocable deed, dated July 7, 1993, retained a life estate in the premises hereinafter described and also in said revocable deed conveyed the remainder interest in said premises to the party of the second part if the party of the second part survives the party of the first part, with said remainder interest being conveyed to a Trust, established by the party of the first part under a Trust Agreement, dated July 7, 1993 (which was amended on March 8, 1999), if the party of the second part does not survive the party of the first part; and WHEREAS, both the party of the first part and the party of the second part are presentiy surviving, and the party of the first part now desires to utilize her power to revoke the prior deed, dated July 7,1993, and to now convey a 100% fee interest in said premises to the party of the second part, so that neither the party of the first part nor the said Trust will have any further interest in said premises. WITNESSETH, that the party of the first part, in consideration of Friendship and no dollars, lawful money of the United States, paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel or'land, with the buildings and improvements thereon erected, situate, lying and being in the Fleets Neck, Town of Southold, County of Suffolk and State of New York, known as the map of property ofRA V A TONE REALTY CORPORATION at Fleets Neck, Cute hogue, Suffolk County, New York, bounded and described as follows: Ld ~{) <#' '//)3/ sec.1 HI1If'f' 5-" BEGINNING at a point, which said point is North 570 45' East, three hundred and twenty-five (325') feet from the Easterly side of Pequash Avenue and on the northerly side of a proposed road, named Stoutenburg Road; running thence North 320 15' West along the westerly side of a further proposed road, named Hamilton Road, a distance of one hundred and fifty (150') feet; running thence south 570 45' west, a distance of seventy five (75') feet; running thence south 320 15' East, a distance of one hundred and fifty (150') feet, to the northerly side of Stoutenburg Road; running thence north 570 45' East along said Stoutenburg Road, a distance of seventy-five (75') feet to the point or place of beginning. TOGETHER with a right-of-way over the proposed road, which said proposed road is more fully described as follows: - BEGINNING at a point on the westerly side of Betts Street, which said point is North 140 15' West. a distance offifty (50') feet from a concrete monument set as a bound on the Westerly side of Betts Street on the southeast corner of the property formerly owned by the Ravatone Realty Corp, and running thence south 660 30' West, along the southerly side of a proposed road, a distance of one hundred and fifty-nine and fifteen one-hundreds (159.15') feet, and continuing along the southerly side of a said proposed road south 570 45' West, a distance of five hundred and fifty-nine and three tenths (559.3') feet, to the Easterly side of Pequash Avenue, thence along said Easterly side of Pequash Avenue, north 320 15' West, a distance of thirty-seven (37') feet, thence North 570 45' East, along the Northerly side of said proposed road, a distance of five hundred and sixty-two (562') feet thence continuing along the Northerly side of said proposed road North 660 30' East, a distance of one hundred and sixty-eight (168') feet, to the Westerly side of Betts Street; running thence along the westerly side of Betts Street south 140 15' East, a distance of thirty-seven (37') feet more or less to the point of place of beginning. Said premises is sometimes known by the street number 245 Glenwood Road, Cutchogue, New York 11935. This deed revokes the aforesaid deed, from the party of the first part, dated July 7, 1993 (recorded on September 28, 1993 [at Liber 11646, Page 54] in the Office ofthe County Clerk, County of Suffolk, State of New York) and supersedes said earlier deed by the party of the first part who is now unconditionally conveying a complete fee interest in said premises to the party of the second part, thereby revoking the life estate retained by the party of the first part and revoking any contingent interests in the remainder formerly held by the party of the second part and the aforesaid trust. The party of the first part had an unconditional right to revoke (without the consent of anyone else) the aforesaid revocable July 7, 1993 deed, The purpose of this November Cf, 2000 deed is to now give the party of the second part (SUSAN CONNELL) an unconditional complete fee interest in the aforesaid premises, AND lhe party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that lhe party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvemenl and will apply the same first to lhe pay- ment of the cost of the improvement before using any part of the tOlal of the same for any other purpose, The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
