Trustee of the Ernest E. Wilsberg Revocable Trust dated March 26, 1991,
party of the first part, and

party of the second part,
WITNESSETH, that the party of the first part, in consideration of-----TEN AND 00/100 ($10.00)-----dollars paid
by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
AiLL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lYing and being at Mattituck, in the Town of Southold, County of Suffolk and State of New York, and being
more particularly bounded and described as follows:
COMMENCING at a point 30 feet southeasteriy along a line which line is a continuation of the
southwesterly line of land of Ernest Wilsberg and the northeasterly line of the land of John Eller, Sr., said point
of beginning being 30 feet southeasterly along said line from the southwesterly corner of the land of Ernest
Wilsberg and the southeasterly corner of the land of John Eller, Sr.;
RUNNING THENCE in a general southeasterly direction along a continuation of the aforesaid line to
thl~ edge of a right of way, a point 25 feet along said line aforesaid from the easterly and southeasterly
boundary of the land of Julius Zebroski;
RUNNING THENCE along a line 25 feet from the easterly and southeasterly boundary of the lands of
Julius Zebroski along the edge of the aforesaid right of way 200 feet or more in a northeasterly direction to a
point where the line is the northeasterly line of the aforesaid right of way, 25 feet from the easterly and
southeasterly boundary of the lands of Julius Zebroski, intersects a line which is a continuation of the
boundary line between the lands of Ernest Wilsberg and the lands of Schwefe/;
THENCE in a northwesterly direction along a line which is a continuation of the boundary line, the
northeasterly boundary of the lands of Wilsberg and the southwesterly boundary of the land of Schwefel to a
pomt 30 feet in a southeasterly direction along said line from the southeasterly corner of the lands of Wilsberg
and the southwesterly corner of the lands of Schwefel;
THENCE along a line distant 30 feet in a southeasterly direction from the said southeasterly boundary
of the lands of Wilsberg, and parallel to said southeasterly boundary, 200 feet or more to the point or place of
BEGINNING.
TOGETHER WITH a right of way, if any, over a certain 25 foot private road leading from the southeriy
line of New Suffolk Avenue southerly to Peconic Bay.
TOGETHER WITH a free and unobstructed use of the channe/lying adjacent to said premises.
TOGETHER WITH a right of way over a 25 foot right of way leading from Ole Jule Lane to the
northwesterly corner of the lands of Krey, which right of way adjoins the premises hereinabove described on
the southeast side thereof.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated 10/25/94.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AN 0 the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
