Matthews and Ham 38 Nugent Street Southampton, NY 11968 Re: Lot Line Change for the Properties of Grebe, Rafferty and Meyer Located on the south side of Avenue B, approximately 520 feet west of Crescent Avenue, on Fishers Island SCTM#1000-6-2-14 ,15,16 and 17.1 Zoning Districts: R-40 and R-80 Dear Mr. Ham: The Southold Town Planning Board, at a meeting held on Monday, September 8, 2008, adopted the following resolution: WHEREAS, this proposal is to re-configure the lot lines of four parcels, SCTM#1000-6- 2-14, SCTM#1000-6-2-15, SCTM#1000-6-2-16 and SCTM#1000-6-2-17.1 into three parcels in order to reflect actual use; and WHEREAS, following the re-configuration, SCTM#1000-6-2-14 will merge with the flag pole portion of flag lot SCTM#1000-6-2-15 and will equal 11,786 square feet; and WHEREAS, SCTM#1000-6-2-15 will acquire a 16-foot-wide portion of SCTM#1000-6-2- 16 to replace the flag pole portion of the lot as well as a 1,647 square foot portion of SCTM#1000-6-2-17.1 to square off SCTM#1000-6-2-15 thereby eliminating it's flag lot design and will equal 11 ,029 square feet; and WHEREAS, SCTM#1000-6-2-17.1, after transferring 1,647 square feet to SCTM#1000- 6-2-15, will equal 69,428 square feet; and WHEREAS, SCTM#1000-6-2-16 will no longer exist; and WHEREAS, it was determined that the proposal requires lot area relief from the Zoning Board of Appeals in order to reduce the size of SCTM#1 000-6-2-17.1; and Grebe. PROPERTY FACTS/DESCRIPTION: The entire area within which the three parcels exist as single and separate parcels consists 2.12 acres, with frontage along Avenue B and Fox Avenue. The property is improved with existing buildings as shown on the 3/28/03 survey prepared by Richard H. Strouse, L.S., as updated 2/6/07 for the proposed change in boundary lines of the parcels. BASIS OF APPLICATION: Zoning Code Section 280-114, based on the Building Inspector's April 9, 2007 Notice of Disapproval concerning proposed re-arrangement of lot lines for three existing nonconforming lots. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The variance will allow Lots 15 and 14 to become more conforming by including a portion of adjacent land, and Lot 17.1 less conforming, without creating additional building lots. 4. The difficulty has been self-created. The nonconformity of the three parcels existed prior to the creation of the R-40, R-80 district lot size requirements. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Grant the variance stating that lot 14 would become less nonconforming from 10,000 square feet to 11,786 square feet of total lot size, and less nonconforming from 101 feet in width to 117 feet in width. The nonconforming depth of 74 feet will remain. Lot 15 becomes less nonconforming from 8,926 square feet to 11,029 square feel; width from 75 feet to 83 feet' and depth from 100 feet to 120 feet. Lot 16 will no longer exist because it was merged with the adjacent lots noted above; no new lot will be created.
