party of the first part contemplates developing premises retained by the party of

the second part, by acceptance of the deed hereunder covenants and agrees for
themselves, their successors and assigns, that they have no objection thereto,
and waive any right of objection that may hereafter accrue by reason thereof, and
further eevenants and agrees to exeeate and acknov;edge any and all instruments
deemed necessary by the party of the first part in furtherance of and to effectuate
such development•

the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same cr
