WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever, as to an undivided one-fifth interest.
ALL that certain plot, piece or parcel ofland, with the buildings and improvements thereon erected, situate, lying
andbeing~ at Mattituck, Town of Southold, Suffolk County, New York, bounded
and described as follows:
BEGINNING at a point on the northerly line of Middle Road, the southeast corner
of the premises herein described, adjoining land now or 'formerly of Frederick
Kreh on the East;
RUNNING THENCE along land now or formerly of Frederick Kreh, in a northerly
direction to mean high water mark of Long Creek (a branch of Mattituck Creek);
RUNNING THENCE in a westerly direction along the mean high water mark of Long
Creek 175.00 feet more or less to land now or formerly of Epstein;
RUNNING THENCE along said land now or formerly of Epstein in a southerly direction
to thenortherly line of Middle Road;
RUNNING THENCE in an easterly direction along the northerly line of Middle

TOGETHER with all the right, title and interest of the party of the first part
of, in and to land below high water mark and under the waters of Long Creek,
adjacent to said premises.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
part by deed dated 3/7/91 and recorded on 3/15/91 in the Suffolk County Clerk's
Office in Liber 11232 page 337. ~
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and wiII hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and wjll apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

ALL that certain plot, piece, or parcel of land, situate, lying and being at Mattituck, in the Town of Southold,
County of Suffolk and State of New York, being bounded and described as follows:
BEGINNING at a point on the northerly side of Wickham Avenue distant 526.43 feet as measured along same
from Grand Avenue, said point also being the easterly line of land now or formerly of Kelly;
RUNNING THENCE along said lands, North 53 degrees 33 minutes 30 seconds West, 280.51 feet to Long
Creek;
RUNNING THENCE along the mean high water mark of Long Creek the following five (5) tie line courses and
distances:
1. North 57 degrees 50 minutes 16 seconds East, 61.91 feet;
2. North 89 degrees 27 minutes 42 seconds East, 46.11 feet;
3. South 51 degrees 46 minutes 10 seconds East, 17.10 feet;
4. North S9 degrees 56 minutes 19 seconds East, 58.78 feet;
5. North 85 degrees 44 minutes 11 seconds East, 39.08 feet to land now or formerly of Walts;
RUNNING THENCE along said lands South 37 degrees 43 minutes 40 seconds East, 220.13 feet to the
northerly side of Wickham Avenue;
RUNNING THENCE along the northerly side of Wickham Avenue the following two (2) courses and distances:
