WITNESSETH, that the party of the first part, in consideration of Ten Thousand Dollars ($10,000) paid by the
party of the second'p.art, does hereby grant and release unto the party of the second part, the heirs or successors
and assigns, of the p;~rty of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more particularly
bounded and described as follows:

BEING AND INTENDED TO BE a portion of the same premises conveyed to the party of the first part by deed,
dated January 4, 2002 and recorded in the Office of the Suffolk County Clerk on February 5, 2002 in Libor 12167
page 590.
By accepting this deed the party of the second part acknowledges and agrees that the above described premises
will merge with (i) other premises adjoining the above described premises on the east currently designated on the
Suffolk County Tax Map as District 1000, Section 6, Block 2, Lot 14 acquired by the party of the second part as
Parcel I by deed recorded in Libor 6748 page 269 and (ii) other premises adjoining the above described premises
on the west consisting of an approximately four-foot-wide by one hundred eight-foot-long parcel remaining in the
party of the second part after the conveyance by the party of the second part to the party of the first part, by deed
being recorded simultaneously herewith, of an approximately sixteen-foot-wide by one hundred eight-foot-long
portion of the parcel currently designated on the Suffolk County Tax Map as District 1000, Section 6, Block 2, Lot
16 acquired by the party of the second part as Parcel II by said deed recorded in Liber 6748 page 269, so as to
form a single pamel under the Town of Southold Zoning Code·
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof: TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of tl~e cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
