WITNESSETH, that the party ofthe first part, in consideration of the sum ofTen ($10.00) Dollars and other
good and valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs, or successors and assigns of the party of the second part forever.

BEING and intended to be the same premises as conveyed to the grantor herein by deed dated June 3, 1998
and recorded June 19,1998, in the office ofthe Clerk of the County of Suffolk, in Liber 11900 page 273.
SAID PREMISES commonly known as 245 Racoon Road, Mattituck, New York 11953.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the firs part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs, or successors and assigns of the party
of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the costs of the improvement and will apply the
same first to the payment of the cost of the improvement, before using any part of the total of the same for any
other purpose.
The word "party" shall be construed as if it read "parties' whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Mattituck, Town of South old, Suffolk County, New York
described as follows: .
BEGINNING at a concrete monument set on the easterly line of a certain 24 foot
right-of-way known as Raccoon Road, which said point of beginning is located the
following courses and distances from the point of intersection of the easterly fine
of Cox Neck Road (a public highway) and the southerly line of a private road known as
Miller's Right-of-Way;
(1) South 850 30' East, a distance, of 1,147.61 feet, more or less, to a concrete monument set at
the southeasterly corner of the intersection Raccoon Road and Miller's Right-of-Way;
(2) South 180 07' 30" East 185.33 feet to a concrete monument from said point of beginning;
RUNNING THENCE North 71 0 52'30" East 134.25 feet to a concrete monument
and land now or formerly of Talbat;
RUNNING THENCE South 22' 30' East 125.36 feet through a concrete monument to a point;
RUNNING THENCE South 710 52' 30" west 143.81 feet to a concrete monument and the
easterly line of said 24 foot right-of-way known as Racoon Road;
RUNNING THENCE along the easterly line of said 24 foot right-of-way known as Raccoon
Road North 180 07' 30" West 125.00 feet to a concrete monument set at the point or place of

ALSO all that other piece or parcel of land lying immediately to the west of the parcel above
described and comprising a portion of tbe land lying in the bed of said 24 foot right-of-way

(1) A certain private road known as Miller's Right of Way being 24 feet in width running in
a general easterly direction from the easterly side of Cox Neck Road (a public highway) to a
point 1,466.05 feet, more or less, from said easterly side of Cox Neck Road.
(2) A certain 24 foot private right-of-way known as Raccoon Road, running from a point on
the southerly side of said Miller's Right-of- Way South IS' 07' 30" East a distance of 570.33
feel.
(3) Another 24 foot right-of-way known as Deer Path Road, running from a point on the
southerly line of said Miller's Right-of-Way South 22" 30' East a distance of 449.50 feet.
(4) Another 24 foot right-of-way known as Fox Hollow Road, running South 71' 52' 30"
West a distance of 720.37 feet in a general East-West direction completely across the property
now or formerly of William H. Wertenberg.
(5) A certain parcel of land lying between the westerly end of the last above mentioned 24
foot right-of-way known as Fox Hollow Road and the shores of Mattituck Creek bounded
and described a follows:
BEGINNING at a point on the southerly line of said 24 foot right of way known as Fox
Hollow Road, which point is located North 71052'30" East, a distance of 10.06 feet from the
cnncrete monnment set on the end of said Fox Hollow "Road at tile southwesterly comer
thereof;
RUNNING THENCE South 12' 07' East, a distance of244.52 feet to a point;
RUNNING THENCE North 71 ' 52' 30" East a distance of 60.S7 feet to a concrete
monument;
RUNNING THENCE Sonth ISO 07' 30" East, a distance of 84 feet, more or less, to the
shores of Mattituck Creek;
RUNNING THENCE in a general westerly direction along the shores of Mattituck Creek, a
distance of 75 feet, more or less, to a point and lands formerly of Young;
RUNNING THENCE North 120 07' West along, said lands formerly of Young, a distance of
305 feet, more or less, to a concrete monument set on the southerly one of Sliid 24 foot right-
