THIS INDENTURE, made the 17~ day of April, 2008

DAVID S. HORTON and HERMINE HORTON, residing at No. # Kirkup Lane, Mattituck, New York, party
of the first part, and
DAVID S. HORTON and HERMINE HORTON, residing Bt No. # Kirkup Lane, Mattituck, New York, as
Trustees of the HERMINE HORTON TRUST, dated November 28, 1991, as Restated April 17th, 2008,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 00/100-($10.)--Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being at Mattituck, in the Town of Southold, County of Suffolk and State of New York, being
more particularly bounded and described as follows:
BEGINNING at a point on the southwest corner of the premises described herein, adjoining lands now or
formerly of Peconic Homes Corporation and lands now or formerly of Daniel Jacoby, which point is
3,639.26 feet, more or less, along a private road known as Kirkup Lane, from the southerly side of Sound
Avenue;
RUNNING THENCE from said point of beginning along land now or formerly of Peconic Homes
Corporation, North 19 degrees, 30 minutes, 40 seconds West 184.09 to land now or formerly of Gerry L.
Horton;
RUNNING THENCE along said land North 73 degrees, 56 minutes, 30 seconds East 398.51 feet to a
point at or near the shoreline of Laurel Lake;
THENCE southerly along the shoreline of Laurel Lake to land now or formerly of Jacoby, tie lines along
Laurel Lake having the following two (2) courses and distances:
1. South 24 degrees, 58 minutes, 30 seconds East 64.45 feet;
2. South 37 degrees, 38 minutes, 00 seconds East 150.02 feet;
THENCE southwesterly along the land now or formerly of Jacoby South 76 degrees, 23 minutes, 59
seconds West 453.00 feet to the point or place of BEGINNING.
TOGETHER with a 16' Right of Way from Sound Avenue to the westerly side of the premises, as set forth
in Boundary Line & Easement Agreement dated May 16, 1986;
Together with lands of the parties of the first part now or formerly under the waters of Laurel Lake.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
July 2, 1987 and recorded in the Suffolk County Clerk's Office in Liber 10431 page 385, and by deed
dated December 2, 1986 and recorded in Liber 10431 page 383, less the premises conveyed to Jacoby by
the party of the first part by deed dated July 2, 1987 and recorded in Liber 10431 page 381.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read 'parties" whenever the
sense of this indenture so requires.
