THIS INDENTURE, made December t~. 2007, between Dorothy Sargeant, as surviving tanant by the
entirety of Dorothy Sargeant'and Howland H. Sargeant, Deceased, 1155 Old Harbor Road, New Suffolk, New
York, party of the first part, and Dorothy Psathas Sargeant, as Trustee of the Dorothy Psathas Sargeant Trust,
dated December LLg, 2007, I 177 Old Harbor Road, New Suffolk, New York. party of thc second part,
WITNESSETH, for no consideration, the party of the first part does hereby grant and release unto the
party oftbe second part, the heirs or successors and assigns oftbe party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,

RUNNING THENCE along said center line ofsaid right of way north 23 degrees 23 minutes east 100
feet to a concrete monument and other land of James C. Whelan;
THENCE along other land of James C. Whelan the following iwo courses and distances:
I) South 79 degrees 31 minutes east 10.26 feet to an iron pipe;
2) South 54 degrees 59 minutes east 183.00 feet to the ordinary high water mark of Cutahogue Harbor;
THENCE along the ordinary high water mark of Cutchogue Harbor along a tie line course and distance
19 degrees l0 minutes 20 seconds west 119.05 feet to other lands of James C. Whelan;
THENCE along other land of James C. Whelan the following two courses and distances:
I) North 49 degrees 13 minutes west 197.00 feet to an iron pipe:

of beginning.
TOGETHER with an easement and right of way for the purpose of ingress and egress between said
premises and Old Harbor Road for persons, vehicles and animals to be used in common with James C. Whelan
and Elizabeth F. Whelan, his wife. their successors and assigns and present and future owners of any property
abutting on right of way and their guests over and across a strip of land 20 feet in width running from the
southeasterly coroer of said premises southerly about 95 feet to Old Harbor Road the center line of said 20 foot
right of way being the extension southerly of the westerly line of said premises and over and across an additional
strip of land of James C. Whelan and Elizabeth F. Whelan, his wife, 10 feet in width adjoining and running along
the westerly line ofsaid premises, reserving to James C. Wbelan and Elizabeth F. Whelan, his wife, and their
successors and assigns an easement and right of way over the westerly 10 feet of said premises for the purposes
of ingress and egress from and to Old Harbor Road by persons, vehicles and animals to be used in common by
James C. Wbelan and present and future owners of property abutting the 20 foot right of way above described
and their guests: and
TOGETHER with a Grant of Easement. dated January I I, 2006. and recorded in the Office of the Clerk
of the County of Suffolk on January 3 I, 2007, in Liber D00012490 Page 060.
TOGETHER with all right, title and interest, if any, ofthe part), of the first pan in and to any streets and
roads abutting the above described premises to the center lines thereof, and TOGETHER with the appurtenances
and all the estate and rights ofthe part), of the first part in and to said premises, TOHAVEAND TOHOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever. AND the party ofthe first pan, in compliance with Section 13 of the Lien Law. covenants
that the party of the first part will receive the consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to be applied first for the purpose of paying the costs of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of the
same tbr any other purpose.
