TOGETHER with the right of way over a certain twenty-five foot (25') private
road leading from the southerly line of New Suffolk Avenue to the Peconic Bay.
BEING AND INTENDED to be the same premises transferred to the party of the
first part by deed dated August 4, 1959 and filed in the Office of the Clerk
of Suffolk County on August 10, 1959 in liber 4672 of deeds at page 498.
THE GRANTOR, Elizabeht R. Kiernan, hereby retains a life estate to the premises.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.

ALL that piece or parcel of land, situate, lying and being
at Mattituck, Town of Southold, County of Suffolk and state
of New York, being more fully described as follows:
BEGINNING at a stake set on the southeasterly line of OleJulane,
which stake is located the following two (2) courses and distances
from a concrete monument set in the southeasterly line of OleJulane
at the intersection of the premises now or formerly of Stella
Thurm and premises now or formerly of Doris E. Wilsberg, and
which concrete monument 1s the northwesterly corner of lands
conveyed to said Doris E. Wilsberg by Julius Zebroski by deed
dated January 2, 1951 and recorded in the Suffolk County Clerk's
Office in Li ber 3176 of Deeds at Page 191:
(1) South 80 degrees 39 minutes 50 seconds west 164.67 feet;
(2) South 74 degrees 41 minutes 10 seconds west 52.53 feet;
thence from said stake so situated still along the southeasterly
line of Olejulane the following two (2) courses and distances:
(1) South 74 degrees 41 minutes 10 seconds west 25.54 feet;
(2) South 64 degrees 41 minutes 00 seconds west 83.05 feet to
a stake;
thence from said stake south 34 degrees 47 minutes GO seconds
east, 137.58 feet to a stake;
thence north 69 degrees 02 minutes 30 seconds east 103.11 feet
to a stake;
thence north 32 degrees 23 minutes 40 seconds west 140.17 feet
to the stake set at the point or place of beginning.
