valuable consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,

follows:
BEGINNING at a point on the norther1y side of Main Road distant 507.16 feet westerly as measured
along the same, from the point on the northerly side of Main Road where the same is intersected
by the westerly side of land now or formerly of the State of New York, said point being also the
westElrly side of land now or formerly of TMCK Associates;
RUNNING THENCE along the northerly side of Main Road, South 51 degrees 58 minutes 50
seconds West, 120.00 feet to the easterly side of land now or formerly of Sidney and Eleanor
Packllr;
THENCE along said land the following two (2) courses and distances:
1) North 37 degrees 57 minutes 50 seconds West, 100.00 feet;
2) North 23 degrees 03 minutes 00 seconds West, 316.82 feet;
THENCE North 58 degrees 32 minutes 00 seconds East, 39.12 feet to the westerly side of land now
or fOlrmerly of TMCK Associates;
THENCE along said land, South 37 degrees 54 minutes 20 seconds East, 401.61 feet to the
northerly side of Main Road to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated 11/10/2000 and recorded simultaneously herewith.
TOGETHER with all right. title and interest, if any, of the party of the first part in and to any streets and
roadll abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part. the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first P.l'!11'covenants that the party of the first part has not done or suffered anything

AND the party of the first part, in compliance with Section 13 of the Lien Law. covenants that the party of

consiideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total
of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever
the sense of this indenture so requires.
