BARGAIN AND SALE DEED WITH COVENANT AGAINST

party of the second part,
WITNESSETH, that the party of the first part, in consideration of one dollar ($1.00), lawful
money of the United States, paid by the party oftqe second p'art, does hereby'grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever,
ALL that certain plot, piece or parcel ofland, with the buildings and improvements thereon
erected, situate, lying and being at Orient, Town of Southold, County of Suffolk and State of New
York, being more particularly bounded and described as follows;
BEGINNING at a monument set at a deflection in the northerly side of Main Road at the point of
intersection of the southeasterly comer ofland now or formerly of Wood hollow Properties, Inc.
and being the southwesterly comer of the land described herein; from said point extending along
said land of Wood hollow Properties, Inc., two courses;
NORTH 0 degrees 46 minutes 20 seconds West. 229.08 feet;
NORTH 87 degrees 09 minutes 40 seconds East, 172.56 feet to land formerly of Edwin H. King
and now or formerly of John L. Brissel;
THENCE along said land of Brissel, South 0 degrees 15 minutes 00 seconds East, 191.52 feet to
the point or another deflection in the northerly side of Main Road;
THENCE along the northerly side of Main Road, South 74 degrees 50 minutes 30 seconds West,
176.23 feet to the point or place of BEGINNING.
BEING and intended to be the same premises conveyed to the party of the first part by deed dated
8/2/90 and recorded on 8/7/90 in Liber 11116, Page 427.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to Said premises,
TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost ofthe
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
