WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel ofland, with the buildings and improvements thereon erected, situate, lying
and being at Mattituck, Town of Southold, County of Suffolk and State of New York, hounded and described as fol101ls:
BEGINNING at a point on the southeasterly line of peconic Bay Boulevard at the southeasterly corner of the
premises herein described adjoining land of Robert and Judith McLaughlin, said point being 0.9 feet south of a concrete
monument; from said point of beginning;
RUNNING THENCE along said land South 21 deg. 06 min. 10 sec. Hast, 399.84 feet to ordinary high water mark of
Great Peconic Bay;
RUNNING THENCH in a southwesterly direction along said Great peconic Bay the tie lil1€ being South 41 deg. 00 min.
44 sec. West, 54.13 feet to land of Bennet and Barbara Hess;
RUNNING THENCH North 20 deg. 26 mio. 30 sec. West, 409.06 feet to the southeasterly line of peconic Bay Boulevard
said point being 0.7 feet south of a concrete monument;
RUNNING THENCE along the southeasterly line of peconic Bay Boulevard, North 48 deg. 23 min. 50 sec. Hast, 46.04
feet to the point or place of BEGINNING.
BBING AND INTENDED TO BH the same premises conveyed to Grantor by deed dated 5/31/94 and recorded at Liber 11681
cp 127 in the Suffolk County Clerk's Office.
This conveyance is subject to and assuming that a certain note and mortgage executed by William F. Coster, III and
Helen A. Coster to Nortb Fork Bank dated 5/31/94 in tbe a1llOUlit of $100,000.00 recorded 6/14/94 in Liber 18832 at Page 602 in
the Suffolk County Clerk's Office, wbich mortgage and obligation secured thereby is DOlI outstanding the principal SUID of
$55,302.72 together with interest thereon wpich the party of the second part, Helen A. Coster, hereby assumes and agrees to
pay. It is understood and agreed that tbe obligation of William F. Coster III under tbe mortgage mentioned above will not
be released.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever. ".
AND the party ofthe first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
