BETWEEN
JOHN L. HURTADO, JR., residing at 9018 Shenandoah Circle, Naples, Florida 34113, party of the first
part, and
MCM HOMES, INC., a Now York corporation with offices at 6 Cherry Lane, Mt. Sinai, New York 11766,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten and 001100--($10.00)--Dollars, and
other good and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, situate, lying and being in the Town Df Southold, County of
Suffolk and State of New York, known and designated as Lot no. 4 as shown on a certain map entitled,
~Map of Forestbrook at Bayview" and filed in the Office of the Clerk of the County of Suffolk on June 15,
2004 as Map Number 11119, said lot being more particularly bounded and described as follows:
BEGINNING at a point on the northeasterly side of Red Fawn Road where the same is intersected by the
division line between Lots 3 and 4 as shown on the aforesaid map, said point or place of beginning being
distant 574.59 feet northerly and northwesterly as measured along the easterly and northeasterly side of
Red Fawn Road from the northerly end of a curve which curve connects the northerly side of North
Bayview Road with the easterly side of Red Fawn Road;
RUNNING THENCE from said point or place of beginning along the northeasterly and northerly side of
Red Fawn Road in a northwesterly and westerly direction along the arc of a curve bearing to the left
having a radius of 60.00 feet a distance of 65.28 feet to the division line between Lots 4 and 5;
RUNNING THENCE along said division line, North 43 degrees 58 minutes 40 seconds West, 292.00 feet
to the division line between Lots 4 and 7:
RUNNING THENCE along said division line in a northeasterly and easterly direction along the arc of a
curve bearing to the right having a radius of 352.00 feet a distance of 382.96 feet to the division line
between Lots 3 and 4; and
THENCE along said division line, South 18 degrees 21 minutes 24 seconds West, 292.00 feet to the
northeasterly side of Red Fawn Road, the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated
6/17104, recorded 712104 in Liber 12328 page 611.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE
AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for. this .conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party' shall be construed as if it read 'parties" whenever the
sense of this indenture so requires.
