Y., as j part of the consideracion for the issuance of the Permit does understand and prescribe to the fol- ~ lowing: r 1. That the said Boazd of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising drrectly or indirectly as a result of any oper- a tion performed pursuant to this permit, and the said Permittee will, at his or her own expense, h; ' r'efend any and all such suits initiated by thud games, and the said Permittee assumes full liability ,. ith respect thereto, to the complete exclusion of the Boazd of Trustees of the Town of Southold a 2. That this Permit is valid for a period of coos, which is considered to be the estimated time required to complete the work involved, but should circumstances wazrant, request for an extension may be made to the Boazd at a later date. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that auth- orization was originally obtained. _ 4. That the work invoh•ed will be subjett to the inspection and approval of the Board or its age^ts, a^d ^on-compliance with the provisions of the originating application, may be cause for F revocation of this Permit by reso]ution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. ~ - 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water mazks. 7. That $ furore operations of the Town of Southold require the removal and/ot alterations in the location of the work herein authorized, oz if, in the opinion of the Boazd of Trustees, the work shall cause unreasonable obstrurnon to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work auth- ~( prized. i 9. CHIEF [N OIN EER June 3, 1976 Re: Southold Town Trustee Permits Your letter of May 20th, 1976 Thank you for your prompt processing of our permit applica- tions for the various projects in the Town of Southold and for your comments and suggestions contained therein. The surplus material areas indicated on our permit drawings are set forth in the State and Federal Permits issued for each project. In each instance, it required one to two years to obtain a consensus from the numerous Agencies on site location. To effect a change at this point in time would be virtually impossible. This project is modest in scope to afford an immediate relief to this critically shoaled situation and will be com- pleted by land based crane.
