party of the second part,
WITNESSETH,thalthe party of the first part, in consideration often dollars and other valuable consideration paid
by the party of the second part, does hereby remise, release and quitclaim unto the party of the seco'nd'part, the
heirs or successors and assigns of the party of the second part forever,
ALL of the right, title, and interest - of every nature and kind, from whatever source derived or deriving, and
whether obtained by deed, conveyance, will, operation of law, or otherwise - of the party of the first part in and
to the premises described on "Schedule A" annexed hereto, including, but not limited to, any and all fee,
easement, and license rights to pass or repass on, or in any other way to enter upon or use the said premises.
RESERVING, HOWEVER, a limited right - during the lifetimes of Grantor, the Grantor's son Joseph Townsend,
Jr., and the Grantor's granddaughter Baxter Jane Townsend, but not after the death of the last living of Grantor,
his said son, and his said granddaughter - of (a) the Grantor, (b) the Grantor's said son, (c) the Grantor's said
granddaughter, (d) other members of the Grantor's family when accompanied by the Grantor, the Grantor's said
son, and/or the Grantor's said granddaughter, and (e) guests when accompanied by the Grantor, the Grantor's
said son, and/or the Grantor's said granddaughter, to use "Parcel II" in Schedule "A" hereto.
AND RESERVING, HOWEVER, a limited right-of-way forthe purpose of access to the said "Parcel II" in Schedule
"A" hereto - for so long as the Grantor's family shall have rights to use "Parcel II" in Schedule "A" hereto as set
forth in the preceding paragraph, but not thereafter - to pass over certain portions of "Munn Lane," as such
portions are described in Paragraphs "17" and "22" of a certain "Stipulation of Partial Settlement and
Discontinuance of Action," dated June 22,2000 in a certain action in the Supreme Court of Suffolk County,
New York, entitled Nancv P. Kardwell allainst Barbara Dorman, et aI., bearing Suffolk County Index No. 82-13483.
TOGETHER. with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense ot this indenture so
requires.

ALL the roadways and rights-of-way known and designated on the
"Map of Bungalow Sites, Mantaloking Hills, Orient, N. Y. ," filed
with the Clerk of Suffolk County on September 19, 1908 as Filed
Map. No. 620, and the "Revised Map of Bungalow Sites, Mantaloking
Hills, Orient, N.Y.," filed with the Clerk of Suffolk County on
September 17, 1912 as Filed Map No. 163, both in their locations as
shown upon the said maps, and in their actual locations as of the
date of this deed, EXCEPTING HOWEVER the portions of such roads and
rights - of ..way conveyed or to be conveyed t.o Joseph and Nancy P.
Kardwell pursuant to Paragraph "7" of a certain "Stipulation of
Partial Settlement and Discontinuance of Action," dated June 22,
2000 in a certain action in the Supreme Court of Suffolk County,
New York, entitled Nancy P. Kardwell aqainst Barbara Dorman, et
al., bearing Suffolk County Index No. 82-13483

lying, and being in the Hamlet of Orient in the Town of Southold,
County of Suffolk, and State of New York, being more particularly
bounded and described as follows:
BEGINNING at a point on the northwesterly teminus of "Munn Lane, "
as shown on the "Map of Bungalow Sites, Mantaloking Hills, Orient,
N. Y.," filed with the Clerk of Suffolk County on September 19, 1908
as Filed l>1ap. No. 620, and the "Revised Map of Bungalow Sites,
Mantaloking Hills, Orient, N.Y.," filed with the Clerk of Suffolk
County on September 17, 1912 as Filed Map No. 163, where the said
northwesterly terminus of "Munn Lane" is intersected by the
easterly ",ide of land now or formerly of Ducrot; and
RUNNING THENCE, from said point or place of beginning, North 6
degrees, 44 minutes, 00 seconds East, along land now or formerly of
Ducrot, a distance of 50.00 feet more or less to the mean high
water mark of the Long Island Sound;
THENCE along the mean high water mark of Long Island Sound,' along
a tie line running North 82 degrees, 53 minutes, 00 seconds East,
a distance of 164.27 feet more or less to land now or fomerly of
John Tuthill;
THENCE South 00 degrees, 53 minutes, 00 seconds East, along the
said land now or formerly of John Tuthill, a distance of 75.0 feet
more or less to land now or formerly of Kardwell;

Engineers & Surveyors, Greenport, N.Y., and filed in the Office of
