WITNESSETH, that the PARTY OF THE FIRST PART, in
consideration of FOUR HUNDRED NINETY NINE THOUSAND ONE HUNDRED
FIFTY NINE and 50/100 DOLLARS ($499,159.50) and other good and
valuable consideration paid by the PARTY OF THE SECOND PART,
DOES HEREBY GRANT AND RELEASE unto the PARTY OF THE SECOND PART,
its successors and assigns of the PARTY OF THE SECOND PART
forever, THE DEVELOPMENT RIGHTS, by which is meant the permanent
legal interest and right, as authorized by ~247 of the New York
State General Municipal Law, as amended, and Local Law 16-1981
of the County of Suffolk, as amended, to permit, require or
restrict the use of the premises exclusively for agricultural
production as that term is defined in Local Law 16-1981 of the
County of Suffolk, as amended, and the right to preserve open
space as that term is defined in ~247 of the New York State
General Municipal Law, as amended, and the right to prohibit or
restrict the use of the premises for any purpose other than
agricultural production, to the property described as follows:
ALL, that piece or parcel of land, situated in the Town of
Southold, County of Suffolk, and State of New York, more
particularly bounded and described as follows: (see description
annexed hereto and made a part hereof) :
BEING AND INTENDED to be part of the premises conveyed to
Russell C. McCall by deed dated January 14, 2000 and recorded
immediately prior to this deed.

ALL that certain plot, piece or parcel of land, situate, lying and being at Cutchogue, in the Town of Southold, County of
Suffolk and State of New York, known and designated as part of Lot 2 on a certain map entitled, "Map of Survey of
Property Set-off Lands of Ginsberg Family", and filed in the Office of the Clerk of the County of Suffolk on December
22, 1999 as Map No. 10372, bounded and described as follows:
BEGINNING at a point at the northeasterly corner of the premises herein about to be described, said point being distant
494.47 feet from the southerly side of Main Road (S.R. 25) and said point also being the division line between the
premises herein about to be described and land now or formerly of Peconic Land Trust and County of Suffolk;
