southerly 12.5 feet of Lot 85 as shown on a certain map entitled,
"Map of Eugene Heights", filed in the Suffolk County Clerk's Office
on 10/29/28 as Map Number 856.
BEGINNING at a monument set on the westerly side of Oak Street
distant 610.06 feet south, as measured along the westerly side of
Oak Street, from the corner formed by the intersection of the westerly
side of Oak Street and the southerly side of Pierce Road;
RUNNING THENCE along bhe westerly side of Oak Street south
07 deg. 58 min. 50 sec. east 62.50 feet to a monument and the division
line between lot 87 and lot 88 as shown on said aforementioned map;
RUNNING THENCE along said division line south 82 deg. 01 min.
10 sec. west 125.00 feet to a monument;
RUNNING THENCE north 07 deg. 58 min. 50 sec. west 62.50 feet
to a monument;
RUNNING THENCE through lot 85 north 82 deg. 01 min. 10 sec.
east 125.00 feet to the first mentioned monument set on the westerly
side of Oak Street and the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to Grantor
by deed dated 8/25/95 and recorded 10/31/95 in Liber 11748 cp 125.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights ofthe party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party ofthe first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
