THIS INDENTURE, made the 2:?day of ~ ' Two Thousand
BETWEEN ZAHRA BENZ, residing at 49 Blenheim Drive, Manhasset, NY 11030
party of the first part, and
MINA AGARABI, residing at 675 Westview Drive, Mattituck, NY 11952
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid
by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
PARCEL A: ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate lying and being at Mattituck in the Town of Southold, County of Suffolk and State of New York, described
as Lot Number 10 as shown on a certain map known as "WESTVIEW", said map made by Otto W. Van Tuyl, C.E.
and Surveyor of Greenpoint, New York, and dated February 20, 1953. Said Lot No. 10 is more particularly
bounded and described as follows:
BEGINNING at an iron pipe on the southeasterly side of West view Drive, 510.75 feet southerly and then
southwesterly along the easterly side of said Westview Drive and along said southeasterly line from the southerly
end of a curve connecting said easterly line of Westview Drive with the southerly line of Brower Road, said curve
having a radius of 50 feet; said point of beginning being the northwesterly corner of Lot Number Nine (9) on said
map; from said point of beginning;
RUNNING THENCE along said land of Lot Number 9, South 24 degrees 00 minutes East 200 feet, more
or less, to ordinary high mark of Mattituck Creek, as found in 1950;
THENCE southwesterly along said high water mark, 80 feet, more or less, to other land now or formerly
of William H. Mason and Harry E. Mason;
THENCE along said land North 20 degrees 36 minuted 30 seconds West 21 0 feet, more or less, to an iron
pipe on said southeasterly line of Westview Drive;
THENCE along said southeasterly line of West view Drive, North 57 degrees 32 minutes 50 seconds East
64.63 feet to the point or place of BEGINNING.
PARCEL B: ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate lying and being at Mattituck in the Town of Southold, County of Suffolk and State of New York, generally
bounded and described as follows:
BEGINNING at a pOint on the boundary line between land of Frederick A. Reiff and Florence M. Reiff and
land of John Burns where said boundary line was intersected by ordinary high mark of Mattituck Creek as found
in 1950; said point of beginning being about 200 feet southeasterly along said boundary line from Westview Drive,
from said point of beginning;

0" degrees 00 minutes East 130 feet, more or less, to ordinary high water mark of Mattituck Creek;

O~J'~he grantor herein is the same party who acquired title by deed dated December 23, 1986 and duly
recorded on August 19, 1987 in Liber 10396, page 243..
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a

trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
