Dear Mr. Just:
The South old Town Board of Trustees reviewed the site plan prepared by Charles M.
Thomas, Architect, last revised May 2008, and received on May 28, 2008, and
determined that the demolition of an existing two-story single family dwelling and the
construction of a new two-story single family dwelling is out of the Wetland jurisdiction
under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ens' orE' that all nE'C'E'ssary prF>C<l.,tions are t..kF>n to preVF>nt ..ny "F!r1imF!nt::ltion or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.

I am presently writing you as a follow up to our recent telephone
conversation regarding this property. To help clarify our request for a
"Letter of Non-Jurisdiction" for this project, we have had the architect
modify the plans to depict the 1 00' setback line and to note that there shall
be no work taking place seaward of that line.

Dear Mr. King:
At the present time, we are seeking to obtain a "Letter Of Non-
Jurisdiction" for this project. The applicant is proposing to demolish an
existing two story single family dwelling which is located + 115' landward
of an existing functional timber bulkhead. Applicant is proposing to
construct a new two story single family dwelling which shall be constructed
+ 144' landward of the Apparent High Water Line and + 115' landward of an
existing functional timber bulkhead. New dwelling shall have leaders and
gutters which shall be located greater than 200' landward of the Apparent
High Water Line and greater than 185' landward of the existing functional
timber bulkhead. Prior to the commencement of the demolition of the
existing single family dwelling; a row of staked hay hales and silt fencing
shall be installed and maintained throughout all construction activities.
