RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to
Permit #6907 to modify the proposed fuel tank replacement, specifically the
replacement of the existing fuel tank and pumps with one double-wall fiberglass tank
containing two (2) fuel storage compartments (6,000 gallon gas and 4,000 gallon
diesel), and as depicted on the survey prepared by Sea Level Mapping last dated
January 11, 2009.
This is not a determination from any other agency.

The Board of Town Trustees took the following action during its regular meeting held on
Wed., June 18, 2008 regarding the above matter:
WHEREAS, STRONG'S MARINE, INC. applied to the Southold Town Trustees for a
permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated May 28, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 18, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of STRONG'S
MARINE to construct approx. 344 If. of vinyl bulkhead in place of existing timber
bulkhead; remove +~-4' & +/-31' northerly sections of existing timber bulkhead and

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is EXEMPT pursuant to Chapter 268: Waterfront Consistency
Review, Exempt/Minor actions which are not subject to review.
§ 268-3. Definitions
MINOR ACTIONS -- Include the following actions, which are not subject to review under this
chapter:
B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the
same site, including upgrading buildings to meet building or fire codes, except for structures in
areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit;
GG. Bulkhead to replace existing bulkhead on the applicant's property in the same location
with a silt curtain employed during construction; and [Added 6-6-2006 by L.L. No. 7-2006]
EE. Upgrades to existing fuel tanks
If the proposed actions are approved and to further LWRP Sub Policy 5.3 Protect and
enhance quality of coastal waters, the following Best Management Practices (BMP,s) are
recommended.
1. Installation of a silt fence and hay bales during the replace/upgrade of existing fuel tanks, as
per referenced on survey.
2. Installation of a silt boom during the replacement of the 344 If. of vinyl bulkhead.
5.3 Protect and enhance quality of coastal waters.
B. Minimize disturbance of strearns and creeks including their bed and banks in
order to prevent erosion of soil, increased turbidity, and irregular variation in
velocity, temperature, and level of water.
C. Protect water quality of coastal waters from adverse impacts associated with
excavation, fill, dredging, and disposal of dredged material.
The BMP's recommended above are required construction and operation standards
pursuant § 275-11.
§275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:
(2) Erosion control. Installation of an erosion control structure is necessary during any
building, grading, landscaping or site work activity within Trustee jurisdiction. This structure
may include, but is not limited to, installation of a silt fence, hay hales, wood chip berm and silt
booms. The placement of the erosion control structure(s) shall be determined by the Trustees or
their designee. All intertidal construction and excavation requires the installation of a silt
boom that will retain all suspended sediments within the immediate project area.

association with an application to the Board of Trustees for a Town Wetlands Permit to construct
vinyl bulkheading in place of existing tlmbex bulkheading and to maintain previously existing
navigable water depths in the dockage area of the commercial marina facility.
I have indicated that all policies are "Not Applicable," because pursuant to Town Code §268-
