That the said Board of Trustees and the Town of South old are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees ofthe Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution ofthe said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion ofthe work authorized. 9. Moore, Esq. on behalf of MATT-A-MAR MARINA, LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 276 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 9, 2008, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 23, 2008, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 . . SCTM#114-3-1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of South old Town Code and the Local Waterfront Revitalization Program (L WRP) Policy Standards. Based upon the information provided on the L WRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the following LWRP Policies and therefore is CONSISTENT with the LWRP. The proposed action is located in Mattituck Creek. recOl!Dized bv the State as a ReI!ional Maritime Center and zoned as Marine Zone II in the Town of Southold. The intent of policv 10 as referenced below is to protect existin!! water- dependent commercial. industrial. and recreational uses and to enhance the economic viability of water-dependent uses bv ensurin!! adequate provision of infrastructure for water-dependent uses and their efficient operation. Policy 10 Protect Southold's water-dependent uses and promote siting of new waterdependent uses in suitable locations. Policy Standards 10.1 (b) Improve the economic viability of water-dependent uses by allowing for non-water dependent accessory and multiple uses, particularly water enhanced and maritime support services where sufficient upland exists. The term water-enhanced use means a use or activity which does not require a location adjacent to coastal waters, but whose location on the waterfront adds to the public use and enjoyment of the water's edge. Water-enhanced uses are primarily recreational, cultural, retail, or entertainment in nature. These uses may be necessary for the successful financial operation and viability of water-dependent uses. (Table # 1) The following water-dependent is permitted. Marine II Permitted Use: 5. Boat yard for building, storing, repairing, renting, selling or servicing boats which may include the following as an accessory use: office for the sale of marine equipment or products, dockside facilities for dispensing of fuel and where pumpout stations are provided, restroom and laundry facilities to serve overnight patrons. Maritime activity in Southold tradl.allv has been concentrated in the harb! inlets and creeks. As noted earlier in P'olicv 10. Policv 1 promotes a continuation of this traditional oattern of maritime activity. suooortine the economic base. maintainine the maritime character of the Town. and avoidine disturbance of the remainine natural shoreline and water areas. It also recoenized that Mattituck Inlet and Creek. identified bv the state as a reeional Maritime Center. Mill Creek and the Villaee of Greenoort are the orimarv focus of maritime activity within the Town of Southold. Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The policy is intended to foster a development pattern that provides for beneficial use of the environmental, historical, and cultural coastal resources of the Town of South old while maintaining and building on its traditional economic base. The primary components of the desired development pattern are: strengthening the hamlets as centers of activity, maintaining a clear sense of separation between hamlet centers and the countryside, encouraging waterdependent uses to concentrate in existing locations of maritime activity, enhancing stable residential areas, and preserving agriculture, open space and environmentally sensitive coastal resources. Development that does not reinforce the traditional land use pattern of the Town of South old would result in a loss of the community and landscape character of Southold. If the action is aooroved the followine best manaeement practices (BMP's) are recommended: 1. Maximize a permeable buffer landward of the existing retaining wall, running parallel to the entire seaward side of the existing and proposed boat storage building. Currentlv there is a eravel road structure between the existine boat storaee buildine and adiacent wetlands (the adiacent wetlands are aooroximatelv within 6S feet of the existine and proposed boat storaee buildine). 2. The placement of erosion control structures during construction such as silt fence and hay bales. The site ulan provided does not include anv such erosion control measures. The BMP's as reference above will further advance Policv S: Protect and Imorove water aualitv in the Town Southold and sub-oolicv 6.3 D and E as outlined below. 6.3 Protect and restore tidal and freshwater wetlands. In addition to protecting and improving the Town's wetlands, adjacent lands that provide buffers to wetlands must be maintained and enhanced, and where appropriate, reestablished. These buffers are necessary to ensure the long term viability of the Town's wetlands. Where these lands are in private ownership, educating residential owners as to the long-term benefits of compatible land use and landscaping techniques will be essential to maintaining the ecological health of wetland areas. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided. I. Maintain buffers to achieve a high filtration efficiency of surface runoff. ;j . .
