RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #6924 to reduce the size and square footage of the deck and eliminate
the screened porch; remove the existing concrete walkway and plant grass to meet with
grass that is already present on front lawn area, and as depicted on the revised site
plan prepared by Tour de Force Designs, LLC last dated October 9, 2009, and received
on October 16, 2009.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

We are seeking an extension to the permit //6924, issued on July 23, ~2608; to.~:onstruct a one-story
addition to our existing dwelling, and a deck. We are also enclosing a check for $50.00 as required by this
request.
We arc seeking this extension for a few reasons:
As noted on our request and as granted by your Administrative Action of October 21, 2009,
we reduced the size and square footage of the project. This necessitated additional revised
plans to the interior of the main dwelling and delivery of these revised plans to the
prospective building contractor. This then caused more time to be expended for
construction estimates.
While working with the building contractor, it yeas decided to abandon the present septic
systmn and well and proceed with a new septic system and hook up to town water system.
(This was shown on the survey which *aras submitted to the Town Trustees and is not a
change. However, on advice of the building contractor, we have asked the surveyor to show
the existing septic and well as "abandoned.") The surveyor also needed to remove a drywell
which had been shown when we anticipated reconstruction of the small cottage in the rear
of the property which is now not being done.
We have been waiting for more than two months for the surveyor to produce this minor
notation on our survey in order to fde with the Health Departxnent in Yaphank. It seems no
amount of "cajoling" has been successful. We have now been promised what we need by
next week.
With the needed surveys we will immediately file the necessary papers with the Health
Department. We have been advised that is approval can be from six weeks to two months.
The Town 'lYustees' Permit expires July, 2010. If we get approval for an extension, we can begin
construction as soon as we have the Health Department approval and a building permit from the 'Ibwn
Building Dept. We arc anticipating that we will begin the project this summer.

Gentlemen:
As discussed on the telephone last week, we are seeking an Administrative Amendment to the pertmt
#6924, issued on July 23, 2008, to construct a one story addition to our existing dwelling, and a deck and
screened porch.
Enclosed are two copies of an addendum to the plans ot/ginally submitted to you and on which you based
your approval in 2008. We are also enclosing a check for $50.00 as required.
The addendum highlights the changes that we would be making, pending your agreement to the
amendment. The changes are "bubbled" on the plans, and encompass:
1. Less construction: we are reducing the size and square footage of the deck and eliminaUng
screened porch. (See legend on plans as to square footage.)
2. Present Code and Setbacks: changes will comply with code and setbacks and not
necessitate variances.
3. By doing numbers 2 and 3, above, the house will be further from the water.
4. Walkway from front steps to beach: present concrete walkway will be removed and no new
walkway installed; grass will be planted to meet with grass that is already present on front
lawn area.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
July 23. 2008, and in consideration of application fee in the sum of $250.00 paid by Elizabeth & D__avid Branch
and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to construct an 881.44 square foot one-story addition to the
existing dwelling, a 177.42 square foot deck and screened porch addition onto an
existing deck, to be reconstructed, install dryweils, and construct a new 4'x16' pad,
with the condition that the new walkway connected to the new pad is to be made of a
pervious material and in accordance with Chapter 236 of the Town Code-Storm Water
Runoff, and as depicted on the site plan prepared by Tour de Force Designs, LLC, last
dated August 19, 2008, and received on August 25, 2008.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Elizabeth & David Branch, residing at 5160 Indian Neck Lane, Peconic, New
York as part of the consideration for the issuance of the Permit does understand and prescribe
to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action dudng its regular meeting held on
Wednesday, July 23, 2008 regarding the above matter:
WHEREAS, Polywaters Permits LLC, on behalf of ELIZABETH & DAVID BRANCH
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated June 25, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the new walkway connected to the
new pad is to be made of a pervious material and in accordance with chapter 236 of the
Town Code-Storm Water Runoff, and
WHEREAS, a Public Headng was held by the Town Trustees with respect to said
application on July 23, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of ELIZABETH &
DAVID BRANCH to construct an 881.44 square foot one-story addition to the existing
dwelling, a 177.42 square foot deck and screened pomh addition onto an existing deck,
to be reconstructed, install dryweils, and construct a new 4'x16' pad, with the condition

Polywaters Permits on behalf of ELIZABETH & DAVID BRANCH requests a Wetland Permit to
construct an 881.44 sq.t~, one-story addition to the existing dwelling, a 177.42 sq.ft, deck and screened
porch addition onto an existing deck, to be reconstructed, install drywells, and construct a new 4'X 16'
concrete pad. Located: 5160 Indian Neck Lane, Peconic. SCTM#98-4-23
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT
with the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the $outhold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The distance from the edge of wetlands (Beach) to the proposed action(s) is less than
100 feetI a minimum setback distance of 100 feet from the wetland line is required
pursuant to Chapter 275-3. Findings~ purpose~ iurisdiction~ setbacks. Please require
that the applicant amend the application to meet the above policy to the greatest extent
practicable.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfxont Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
