The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., August 19, 2009:
RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to
Permit #6928 to construct a single-family dwelling, a northerly deck, and a second-story
deck and stairs facing the water, with the condition a line of staked hay bales and silt
fencing is installed along the 6' contour line prior to construction, a 10' non-turf planted
buffer area with a 4' wide access path to the water, a pervious driveway, the installation
of gutters, leaders and drywells to contain roof run-off in accordance with Chapter 236-
Stormwater Run-off of the Town Code, and as depicted on the survey prepared by
Peconic Surveyors, P.C. last dated August 14, 2009.
This is not a determination from any other agency.

At the meeting of the Southold Town Conservation Advisory Council held Wed., August
12, 2009, the following recommendation was made:
JOSEPH ZEVlTS to Amend Permit #6928 to construct a single-family dwelling 50' from
the wetland boundary, a northerly deck 48' from the wetland boundary, and a second deck
and stairs facing the water.

Dear Mr. King,
Request is hereby made to amend in-force Trustee Wetland Permit #
6928 to permit the construction of the a single family dwelling with attached
decks driveway and septic system consistent with the enclosed surveys prepared
by Peconic Surveyors P. C. last dated June 26, 2009.
The important changes are that the dwelling is reduced in area from 1248
square feet to 1040 square feet (footprint) with an attached deck off the northern
face of the dwelling and a second small deck and stairs facing the water. The
dwelling is a modular home and would be 50-feet from the wetland boundary and
northerly deck would be 48-feet from the wetland boundary.
Please schedule this matter before your Board during the next regular
meeting. Thank you in advance for your anticipated cooperation.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
July 23, 2008, and in consideration of application fee in the sum of $250.00 paid by Joseph Zevits and subject
to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and
permits the following:
Wetland Permit to construct a two-story wood frame dwelling with attached
deck and attendant sanitary system, with the conditions of a line of staked hay bales
and silt fencing is to be installed along the 6' contour line prior to construction, a 10'
non-turf planted buffer area with a 4' wide access path to the water, a pervious
driveway, relocate the proposed dwelling back to 55' from edge of tidal wetlands, the
installation of gutters, leaders and drywells to contain roof runoff and in accordance
with Chapter 236 of the Town Code-Storm Water Runoff and as depicted on the site
plan prepared by Suffolk Environmental Consulting, Inc., last dated August 5, 2008,
and received on August 6, 2008.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Joseph Zevits, residing at 97 Baylor Avenue, Hillsdale, New Jersey 07642 as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for'damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Tmatees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Sonthold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure t9 obtain same.

Dear Mr. Anderson:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, July 23, 2008 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of JOSEPH ZEVITS
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated June 23, 2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 5 & 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: a line of staked hay bales and silt
fencing is to be installed along the 6' contour line pdor to construction, a 10' non-turf
planted buffer area with a 4' wide access path to the water, a pervious driveway,
relocate the proposed dwelling back to 55' from edge of tidal wetlands, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 23, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of JOSEPH ZEVlTS to
construct a two-story wood frame dwelling with attached deck and attendant sanitary
system, with the conditions of a line of staked hay bales and silt fencing is to be
installed along the 6' contour line prior to construction, a 10' non-turf planted buffer area
with a 4' wide access path to the water, a pervious driveway, relocate the proposed
dwelling back to 55' from edge of tidal wetlands, the installation of gutters, leaders and
drywells to contain roof runoff and in accordance with Chapter 236 of the Town Code-

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The CAC Supports the application to construct a new dwelling with the Condition the
present non-disturbance buffer remains, including the area of mowed phragmites, and all
drainage is graded away from the water.
The CAC does Not Support the proposed stone revetment that was mentioned in the
application because it was not included in the plans or on a survey. It was recommended
that plans be submitted for a further review.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to
me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy
Standard and therefore is INCONSISTENT with the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions.
The distance from the wetlands to the proposed action is approximately 45 feet; a minimum setback distance of
100 feet from the wetland boundary is required pursuant to Chapter 275-3. Findings; purpose; jurisdiction;
setbacks. Please require that the applicant amend the application to meet the above policy to the greatest extent
practicable.
If the action is approved the following best management practice (BMP) is recommended:

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in

As indicated within Policy 1, 'Development that does not reinforce the traditional land use pattern of the To~n of
$outhold would result in a loss of the community and landscape character of Southold :t this project is a proposal to
develop a vacant parcel in an almost entirely developed neighborhood. The proposal~ as designedt will not result in any
adverse effects to the surrounding environment in that the project will be situated as far landward as possible without
requiring a Zoning Varianc% and will be served by a coded sanitary system. Again, the surrounding neighborhood is
comprised of older residential dwellings which have existed harmoniously within this area for years and have not resulted
in any form of adverse effects to the surrounding environment. Accordingly, we believe that this project is consistent with
this policy.

Subject proposal will not adversely impact the visual quality of the surrounding area in that the subject parcel is
substantially vegetated around the peripher% and thereby screened from view. Scenic resources, presumably views of
West Lake, are not in jeopardy because of the aforementioned vegetation, and the lack of any existing lines of sight from
the west side of Little Peconic Bay Lane. In addition, the neighborhood itself is comprised of similarly sized properties~
improved similarly to that which is proposed for many years, and which also has not resulted in any form of adverse
impacts to the surrounding area. Furthermore, this policy could not preclude both the legal creation of this property as a
building Iot~ or the proposed structures thereon, which are proposed as far from West Lake as possible without requiring a
Zoning Variance. Therefore, we feel that the instant proposal fully complies with this Policy.
