paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or

Gilles 794.99 feet northerly along said boundary line from the northerly line of
the Middle Road;
RUNNING THENCE along said land of the seller two courses as follows: (1) South
80 degrees 00 minutes 40 seconds West 331.05 feet;
THENCE (2) North 18 degrees 47 minutes 10 seconds West 265.48 feet to land of
Fowler;
THENCE along said land of Fowler North 71 degrees 12 minutes 50 seconds East
338.79 feet to land of Wells;
THENCE along said land of Wells South 26 degrees 19 minutes 00 seconds East
136.19 feet to a monument;
THENCE along land of Gilles South 9 degrees 32 minutes 20 seconds East 183.49
feet to the' point or place of BEGINNING.

TOGETHER with a 50 foot right of way in common with others for access between
said premis~s and Middle Road, (C.R. 27A); running from the southeast corner of
said premises along the easterly boundary of land of the seller to Middle Road,
the seller reserving, however, exclusive rights to re-locate said right of way
so that access may be obtained from said premises to either Cox's Neck Road, a
public highway, or to Westphalia Road, a public Highway, and the further right
to dedicate said relocated road to the Town of Southold for a public highway.

TOGETHER with all right, title and interest, if any, of the party. of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party ofthe first part has not done or suffered anything whereby
the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as ifit read "parties" whenever the sense of this indenture so requires.
